PRE-LIMINAR JUDGMENT OF PROCEDENCE IN REPLICATION SUITS BY MAGISTRATES: A VIABLE ALTERNATIVE AGAINST PROCESS DELAYS IN CIVIL STATE COURTS

Resumo: Laws 9099/95, 10259/01 and 12152/09, which respectively regulate the Special State, Federal and Fiscal Courts, were published so that access to justice in Brazil may be broadened. However, after twenty years of the establishment of State Special Civil Courts, they are so full up with suits that they have not served their function to de-bureaucratize justice and provide a fast access to justice to the Brazilian population. Current study demonstrates that the application of pre-liminar judgment of procedence in replication suits by magistrates is a viable mechanism for the satisfactory attendance of people with regard to the distribution of justice through the State Special Courts.

Sin embargo, tras casi 20 (veinte) años de la creación de los Tribunales Civiles Estaduales, se encuentran llenos de procesos, no cumpliendo su función de desburocratizar la justicia y conceder un acceso efectivo y célere a la población brasileña. El presente estudio tiene como objetivo, por lo tanto, demostrar que la aplicación del juzgamiento interdicto de procedencia en las causas repetitivas por el juez de 1º grado de jurisdicción constituirá un mecanismo viable para atender satisfactoriamente los brasileños en lo que se refiere a la distribución de la justicia por medio de los Tribunales Especiales Civiles Estaduales.Com o intuito de ampliar o acesso à justiça no Brasil foram publicadas as Leis 9.099/95, 10.259/01 e 12.152/09, que regulamentam os Juizados Especiais Estaduais, Federais e Fazendários, respectivamente. No entanto, após quase 20 (vinte) anos da criação dos Juizados Cíveis Estaduais, encontram-se abarrotados de processos, não cumprindo a sua função de desburocratizar a justiça e de conceder um acesso efetivo e célere à população brasileira.
