The Social Function of Administrative Private Contracts and their Importance for the Rights of the Person

Resumo: The social function of contracts according to article 421 of the Brazilian Civil Code is the source of discussions on alterations and restrictions to the freedom of making contracts, based on the will’s autonomy in administrative contracts. When the principles that foreground public and private contracts are taken into account, it becomes evident that the contract’s social function is an instrument that provides the development of the person’s rights. This is due to the close links with the fundamental right of human dignity (the right to life, health and safety).
