RES JUDICATA AS A CHALLENGE FOR THE CONCRETION OF ADEQUATE COLLECTIVE JURISDICTIONAL TUTELAGE

Resumo: The res judicata, a basic warrant and enhancer of the principle of juridical safety, provides stability to court decisions. In the case of individual tutelage, its existence is centenarian. In the case of collective tutelage, it is the cause of several discussions and difficulties, perhaps due to its recent introduction. When the implications of res judicata in suits that imply meta-individual rights are taken into account, it is important to change, mutatis mutandis, the juridical type and regime of the res judicata in intersubjective court relationships. Due to the ‘massification’ of conflicts and, as a corollary, the ‘de-substantiation of interests’ which depend on the type of collective right involved and the declared sentence, the res judicata will produce changing effects. Current analysis discusses the expansion of the res judicata in collective suits.

Current analysis discusses the expansion of the res judicata in collective suits.El instituto de la cosa juzgada, como garantía fundamental e inductor del principio de la seguridad jurídica, tiene como función conferir estabilidad a las decisiones judiciales. En el ámbito de la tutela individual él es de existencia secular. Sin embargo, en el ámbito de la tutela colectiva, por ser aun de incidencia reciente, sigue provocando debates y dificultades. Para hablar sobre las implicaciones de la cosa juzgada en las acciones que vehiculan derechos meta individuales, se hace necesario, a la mengua de una disciplina legal específica, socorrer, mutatis mutandis, a los aspectos y al régimen jurídico de la cosa juzgada en las relaciones procesuales intersubjetivas. Delante de la tendencia de “masificación” de los conflictos, y por corolario, de la “insubstantivación de los intereses”, a depender de la especie de derecho colectivo involucrado y de la sentencia dictada, la cosa juzgada producirá efectos cambiantes. El estudio acerca de la expansión de la cosa juzgada en las acciones colectivas es el objeto del presente estudio.O instituto da coisa julgada, como garantia fundamental e indutor do princípio da segurança jurídica, tem como função conferir estabilidade às decisões judiciais. No âmbito da tutela individual ele é de existência secular. Não obstante, no âmbito da tutela coletiva, por ser ainda de incidência recente, vem provocando debates e dificuldades. Para falar sobre as implicações da coisa julgada nas ações que veiculam direitos metaindividuais, faz-se mister, à míngua de uma disciplina legal específica, socorrer, mutatis mutandis, às feições e ao regime jurídico da coisa julgada nas relações processuais intersubjetivas. Diante da tendência de “massificação” dos conflitos, e por corolário, da “dessubstantivação dos interesses”, a depender da espécie de direto coletivo envolvido e da sentença prolatada, a coisa julgada produzirá efeitos cambiantes.
