Resumo: | This article has as its central theme of analysis the Guevara Díaz vs. Costa Rica, judged in June 2022 by the Inter-American Court of Human Rights, especially about Anti-Discrimination Law, a category that is projected throughout the judgment of the jurisdictional body of the Inter-American System as fundamental to understanding the need to establish justiciability direct protection of economic, social, cultural and environmental rights (DESCA). The precedent, therefore, innovates by sedimenting the normative force of the principle of progressive development provided for in art. 26 of the American Convention on Human Rights (ACHR), understood, at least until then, as a mere interpretative principle of the ACHR. However, the decision deserves to be highlighted due to the adoption of the Anti-Discrimination Law as a backdrop to enable the direct justiciability of DESCA, opening up a new institutional practice in the IAHRS scenario. In terms of methodology, the research is carried out based on a critical-reflexive review of the themes covered and the use of the hermeneutic phenomenology method. |

In terms of methodology, the research is carried out based on a critical-reflexive review of the themes covered and the use of the hermeneutic phenomenology method.Este artigo tem como tema central de análise o caso Guevara Díaz vs. Costa Rica, julgado em junho de 2022 pela Corte Interamericana de Direitos Humanos, especialmente no que diz respeito ao Direito Antidiscriminatório, categoria que se projeta no decorrer da sentença do órgão jurisdicional do Sistema Interamericano como fundamental para a compreensão da necessidade de se estabelecer a justiciabilidade direta dos direitos econômicos, sociais, culturais e ambientais (DESCA). O precedente, portanto, inova ao sedimentar a força normativa do princípio do desenvolvimento progressivo previsto no art. 26 da Convenção Americana de Direitos Humanos (CADH), compreendido, ao menos até então, como mero princípio interpretativo da CADH. Não obstante, a decisão merece destaque em razão da adoção do Direito Antidiscriminatório como pano de fundo para viabilizar a justiciabilidade direta dos DESCA, escancarando uma nova prática institucional no cenário do SIDH.
