THE RIGHT TO INFORMATION: COLLECTIVE DIMENSION OF FREE SPEECH AND DEMOCRACY

Resumo: The right to information as a collective dimension of freedom of speech is analyzed. Similarities and differences between freedom of speech and freedom of information are identified, with special reference to the responsibility of the informing agents and the role of information in the political participation of citizens. Foregrounded on the democratic theory of freedom of speech, current paper demonstrates that information affects public opinion and claims a right from the state for its protection and promotion. The analytic and normative approach is adopted to this end.

Se identifican las similitudes y las diferencias entre la libertad de expresión y de la información, destacando la responsabilidad del agente informador y el papel de la información en la participación política de los ciudadanos. Basado en la teoría democrática de la libertad de expresión, el objetivo es demostrar que la información ejerce influencia sobre la opinión pública y, por ello, reclama un deber estatal en la protección y promoción efectiva de ese derecho. Metodológicamente, se adopta una perspectiva analítico-normativa como abordaje.Analisa-se o direito à informação como dimensão coletiva da liberdade de expressão. Identificam-se as similaridades e diferenças entre a liberdade de expressão e de informação, destacando a responsabilidade do agente informador e o papel da informação na participação política dos cidadãos. Com base na teoria democrática da liberdade de expressão, o objetivo é demonstrar que a informação exerce influência sobre a opinião pública e, por isso, reclama um dever estatal na proteção e promoção efetiva desse direito.
