THE DEMOCRATIC STATE AND THE FUNDAMENTAL RIGHT TO STRIKE BY TEACHERS OF THE STATE OF PARANÁ, BRAZIL: A CASE STUDY

Resumo: The right to strike as self-defense and as a fundamental right of workers is discussed, ensuring Democracy in conflicts and social needs. A critical analysis on the strike within the public and private milieu is undertaken with special reference to teachers´ strikes in the state of Paraná, Brazil, and the government´s stance in the wake of the right to strike. Current theoretical research is foregrounded on a concrete case. The inductive method is employed by which specific issues give rise to general conclusions. The essay verified whether there was contempt to democracy and the fundamental right to strike.

The essay verified whether there was contempt to democracy and the fundamental right to strike.Ese trabajo trata del derecho de huelga como forma de autodefensa y derecho fundamental del trabajador, de modo a promocionar la democracia en los conflictos y necesidades sociales. Igualmente, se busca realizar un análisis crítico sobre los motivos de la huelga en ámbito público y privado, volviendo la mirada hacia la huelga de los educadores en el Estado de Paraná y la postura del Gobierno Estadual frente al ejercicio del derecho de huelga de los profesores, como estudio de caso. Se trata de una investigación teórica, con análisis de un caso concreto. El método utilizado es inductivo, en el cual, por medio de la observación de cuestiones particulares, se busca otorgar conclusiones generales. Se espera verificar si hubo o no afronta al Estado Democrático de Derecho y al Derecho Fundamental de Huelga en el tema, objeto del estudio.O presente trabalho visa abordar o direito de greve como forma de autodefesa e direito fundamental do trabalhador, de modo a promover a democracia nos conflitos e necessidades sociais. Igualmente, busca-se realizar uma análise crítica acerca da greve no âmbito público e privado, voltando-se o olhar para a greve dos educadores no Estado do Paraná e a postura do governo estadual ante o exercício do direito de greve dos professores, como estudo de caso. Trata-se de pesquisa teórica, com análise de um caso concreto. O método utilizado é o indutivo, no qual, por meio da observação de questões particulares, extraem-se conclusões gerais.
