IN DEFENSE OF SOCIAL SUSTAINABILITY BASED ON THE ETHICS OF ALTERITY: A LITERARY INTERPRETATION OF LEONARDO SCIASCIA´S OPEN DOORS

Resumo: Alterity is proposed as a means for the feasibility of improving relationship in the daily life of lawyers. The following issue is suggested: Can Alterity be the improvement condition of Law to attain Social Sustainability? Current hypothesis suggests a positive reply, or rather, Alterity makes viable social sustainability and thus the humanity policies are a means for its efficaciousness. Leonardo Sciascia´s Open Doors may be inserted within the tradition of studies on Law and Literature in so far as literary narratives offer a wide field of studies that helps in the understanding of juridical issues. Hermeneutical phenomenology foregrounded current research.

Hermeneutical phenomenology foregrounded current research.La presente investigación tiene por objetivo proponer la Alteridad como medio para viabilizar el perfeccionamiento de las relaciones en el cotidiano de los juristas. Para tanto, se propone el siguiente problema de investigación: ¿Alteridad puede ser la condición de perfeccionamiento del Derecho para alcanzarse la Sustentabilidad Social? La hipótesis presentada al problema sugiere que sí, la Alteridad puede viabilizar la sustentabilidad social, proponiéndose, entonces las políticas de humanidad, como medio para su efectuación. Así, inserido en la tradición de los estudios en Derecho & Literatura, el punto de partida para las reflexiones propuestas es la obra Puertas Abiertas, de Leonardo Sciascia, en la medida en que las narrativas literarias ofrecen un amplio campo de estudios que ayudan a la comprensión de problemas jurídicos. El método utilizado para la construcción de la investigación fue el fenomenológico hermenéutico.A presente pesquisa tem por objetivo propor a alteridade como meio para viabilizar o aperfeiçoamento das relações no cotidiano dos juristas. Para tanto, propõe-se o seguinte problema de pesquisa: “Alteridade pode ser a condição de aperfeiçoamento do direito para se alcançar a sustentabilidade social?” A hipótese apresentada ao problema sugere que sim, a alteridade pode viabilizar a sustentabilidade social, propondo-se, então as políticas de humanidade, como meio para sua efetivação. Assim, inserido na tradição dos estudos em direito & literatura, o ponto de partida para as reflexões propostas é a obra Portas Abertas, de Leonardo Sciascia, na medida em que as narrativas literárias oferecem um vasto campo de estudos que auxiliam na compreensão de problemas jurídicos.
