Notes on the Objective Stability of Demand in the Project of the New Civil Code and its Applicability to Safeguard the Environment

Resumo: Several jurists opine that the Objective Stabilization of Demand is basic and indispensible to legal process and defense. The project of the new civil code has made only slight changes in the possibility of modifying pleading and pleading cause after the summons of the defendant. Immutability is logical when the cause refers to individual and private rights. However, when indivisible and unavailable goods are dealt with, such as diffused rights or the juridical environmental good, the principle must be revised. It seems that the opportunity of flexibility will not be conceded by the law-maker who only slightly modified the stabilization of demand in the project of the new civil law.

El proyecto del Nuevo Código del Proceso Civil poco cambia la posibilidad de modificación de pedido y causa de pedido tras la cita del reo. La inmutabilidad es comprensible cuando el bien puesto en juicio referirse a derechos individuales y privados. Sin embargo, cuando trate de bienes indivisibles e indisponibles, como los derechos difusos y, en particular, lo bien jurídico ambiental, el Principio necesita ser revisitado. Nos parece, sin embargo, que la oportunidad de flexibilización no será, infelizmente, aprovechada por el legislador que poco modificó la Estabilización de la Demanda en el Proyecto del Nuevo Código del Proceso Civil.A Estabilização Objetiva da Demanda é considerada por muitos juristas como essencial e imprescindível ao Devido Processo Legal, Contraditório e Ampla Defesa. O projeto do Novo Código de Processo Civil pouco altera a possibilidade de modificação de pedido e causa de pedir após a citação do réu. A imutabilidade é compreensível quando o bem posto em juízo se referir a direitos individuais e privados. No entanto, quando tratar de bens indivisíveis e indisponíveis, como os direitos difusos e, em particular, o bem jurídico ambiental, o Princípio precisa ser revisitado.
