“You Will Construct the Truth With Your Sex”: The Case Luiza Melinho Vs. Brazil Within the Interamerican System of Human Rights

Resumo: Contemporaneity has made visible previously existential aesthetics, with special relevance to the subjects´ concrete experiences. The emergence of such a phenomenon disorganizes traditional juridical dichotomies and challenges the government to develop new perceptions on the subject. However, when the government fails or does not want to adapt itself to this new modality, entities, such as the Interamerican System of Human Rights, may become an efficacious alternative for the acknowledgement and protection of these rights. Current research analyzes in what manner the theme of sexual rights is being incorporated to the ISHR agenda. The emblematic case Luiza Melinho vs. Brazil reveals that, in spite of structural limitations, the Interamerican System has done its utmost towards the concretization of the sexual rights of minorities on the American continent.

La contemporaneidad visibilizó estéticas existenciales antes oprimidas, prestando especial relevancia a las experiencias concretas de los sujetos. La emergencia de ese fenómeno desorganiza las dicotomías jurídicas tradicionales, desafiando a los Estados a desarrollar nuevas percepciones sobre el sujeto. Cuando, sin embargo, el Estado no consigue o no desea adaptarse a ese nuevo escenario, órganos como el Sistema Interamericano de Derechos Humanos (SIDH) pueden revelarse como una alternativa eficaz rumbo al reconocimiento y protección de esos nuevos derechos. Este estudio, por lo tanto, tiene como objetivo, a partir del empleo de la fenomenología hermenéutica, analizar de qué forma el tema de los derechos sexuales han sido incorporado a la agenda del SIDH. Para tanto, se analiza el emblemático caso Luiza Melinho vs. Brasil, lo cual permite deprender que, pese sus limitaciones fático-estructurales, el Sistema Interamericano ha actuado a partir de que está a su alcance rumbo a la concretización de los derechos de minorías sexuales en las Américas.A contemporaneidade visibilizou estéticas existenciais antes oprimidas, emprestando especial relevância às experiências concretas dos sujeitos. A emergência desse fenômeno desorganiza as dicotomias jurídicas tradicionais, desafiando os Estados a desenvolverem novas percepções sobre o sujeito. Quando, no entanto, o Estado não consegue ou mesmo não quer se adaptar a esse novo cenário, órgãos como o Sistema Interamericano de Direitos Humanos (SIDH) podem se revelar como uma alternativa eficaz rumo ao reconhecimento e proteção desses novos direitos. Este estudo, portanto, tem como objetivo, a partir do emprego da fenomenologia hermenêutica, analisar de que maneira o tema dos direitos sexuais vem sendo incorporado à agenda do SIDH.
