The Criminal Legal Treatment of Stalking in the Italian Legal System: Part 1

Resumo: Stalking is a social phenomenon in which the perpetrator repeatedly harasses or persecutes the victim. Statistical research reveals the prevalence of women as the main victims of this conduct, which means that it can be considered a form of gender-based violence. In this study, in addition to analyzing the gender-based character of the conduct of stalking in Italy, we will also discuss the cases of Germany and Spain in order to have the comparative bases to better assess how Italy dealt with the problem, when it criminalized the conduct in 2009. In Germany, the criminalization of stalking happened earlier (in 2007), whereas its criminalization in Spain was introduced in 2015. There are multiple analogies between both norms, a fact that leads us to believe that the Spanish legislator was inspired by German law. In both cases, there are important issues regarding the principle of legality (nullum crimen sine lege stricta).

La investigación estadística revela la prevalencia de las mujeres como principales víctimas de dicha conducta, lo que la caracterizaría como una forma de violencia de género. En este estudio, además de analizar el carácter de género de la conducta de stalking en Italia, también investigaremos su incriminación en Alemania y España con el fin de tener bases comparativas para evaluar mejor su incriminación en la propia Italia, que ocurrió en 2009. En Alemania, la incriminación del stalking ocurrió antes (en 2007), mientras que la regulación española se introdujo en 2015. Existen múltiples analogías entre ambas normas, lo que nos lleva a creer que el legislador español se inspiró en la ley alemana. En ambos casos, hay cuestiones importantes sobre el principio de legalidad (nullum crimen sine lege stricta).O stalking é um fenômeno social no qual o perpetrador realiza assédios insistentes ou persegue com insistência a vítima. Pesquisas estatísticas revelam a prevalência de mulheres como vítimas prioritárias de tal conduta, o que o caracterizaria como uma forma de violência de gênero. No presente artigo, além de analisarmos o caráter de gênero da conduta à luz da realidade italiana, investigaremos também a sua incriminação na Alemanha e na Espanha de forma a preparar as bases de direito comparado para melhor avaliar a sua incriminação na própria Itália, que ocorreu em 2009. Na Alemanha, a incriminação do stalking é anterior (datando de 2007), ao passo que a normativa espanhola foi introduzida em 2015. Há múltiplas analogias entre ambas as normas, o que nos leva a crer que o legislador espanhol tenha se inspirado na normativa alemã.
