Fake News and Democracy: analysis of cases from the Higher Election Court in 2018 and from the point of view of Amartya Sen

Resumo: Society has perceived with great interest the reactions of the Brazilian Higher Election Court (HEC) with regard to the phenomenon of fake news in the 2018 Brazilian presidential election in 2018. The following question may be made: Is such positioning the most adequate for the strengthening of democracy in Brazil? Current analysis of the 2018 resolutions is based on Sen´s freedom concept. It has been stated that careful positions are adequate and society should verify facts permanently. The right to the exercise of freedom of expression is fundamental to prevent and fight against fake news. Juridical intervention is justified when the activity wrecks the credibility of the electoral process and the people fall into serious mistakes.

Surge la siguiente interrogación: ¿Tales posicionamientos son los más adecuados al fortalecimiento de la democracia brasileña? Esta investigación es un análisis de las resoluciones de 2018 anclada en la concepción de libertad en Sen. Se afirma que posiciones cautelosas son adecuadas y la sociedad necesita buscar el esclarecimiento permanente de los hechos. El derecho al ejercicio de la libertad de expresión es esencial para prevenir y combatir las fake news. La intervención judicial se justifica cuando tal acción afecta la credibilidad del proceso electoral y la populación incurre en graves errores.Diversas instâncias da sociedade observaram atentas a atuação do TSE em relação ao fenômeno das fake news nas eleições presidenciais brasileiras de 2018. Surge a seguinte interrogação: Tais posicionamentos são os mais adequados para o fortalecimento da democracia brasileira? Esta investigação é uma análise das resoluções de 2018 amparada na concepção de liberdade em Sen. Afirma-se que posições cautelosas são adequadas e a sociedade precisa buscar o esclarecimento permanente dos fatos. O direito ao exercício da liberdade de expressão é essencial para prevenir e combater as fake news.
