Resumo: | Developments in medicine triggered an improvement in people´s life style and an increase in live expectancy. However, in technological terms, the agony of people with terminal diseases has been prolonged occurred. Consequently, there has also been a prolongment of the agony of relatives within the context of the objectification of people to the detriment to human dignity. Current paper reflects on whether life may be considered a duty or a right enacted according to autonomy of the will. Taking into consideration that artificial respirators and artificial feeding may reduce the human being to an object, one should ask whether living is a duty or a right within the context of previous manifestation of will with discernment? A bibliographical research shows that life has a broad meaning and should not be limited to an antonym of death. |

El desarrollo de la medicina permitió la mejora del bienestar de las personas y el aumento de la expectativa de vida. Sin embargo, también hubo el permiso, en términos tecnológicos, de prolongarse la agonía de personas con enfermedades terminales y, consecuentemente, la agonía de los familiares, llevando a la “cosificación” del individuo humano en detrimento de la dignidad humana. En el presente artículo se tiene como objetivo fomentar consideraciones reflexivas sobre la vida ser definida como un deber o un derecho pasible de ejercicio de acuerdo con la autonomía de la voluntad. Partiéndose del presupuesto de que la existencia de respiradores artificiales y de sondas para alimentación puede llevar el individuo humano a la condición de “cosa”, se indaga, en los casos de previa manifestación de voluntad con discernimiento: ¿vivir debe ser considerado un deber o un derecho? A partir de investigación bibliográfica, siguiendo el método deductivo, se verifica que la vida tiene significación amplia, no pudiendo ser delimitada como antónimo de muerte. O desenvolvimento da medicina permitiu a melhora do bem-estar das pessoas e o aumento da expectativa de vida. Todavia, também houve a permissão, em termos tecnológicos, de se prolongar a agonia de pessoas com doenças terminais e, consequentemente, a agonia dos familiares, levando à “coisificação” do indivíduo humano em detrimento da dignidade humana. O presente artigo tem como objetivo fomentar considerações reflexivas sobre a vida ser definida como um dever ou um direito passível de exercício conforme a autonomia da vontade. Partindo-se do pressuposto de que a existência de respiradores artificiais e de sondas para alimentação pode levar o indivíduo humano à condição de “coisa”, indaga-se, nos casos de prévia manifestação de vontade com discernimento: viver deve ser considerado um dever ou um direito? A partir de pesquisa bibliográfica, seguindo o método dedutivo, verifica-se que a vida tem significação ampla, não podendo ser delimitada como antônimo de morte.
