International Protection of the Rights of Persons With Special Needs: Analysis of the Constitutional Treatment in Brazil and Argentina with the Purpose of Ensuring Quality of Life and Self-Determination of the Individual

Resumo: The purpose of this work is to analyze its reception in the legal systems of Brazil and Argentina from the prism of the International Convention on the Rights of Persons with Disabilities. At first, the terminology used at work will be defined, that is, “person with special needs”, which denotes the broadening of the universe of people benefited by the Convention, in order to remove the stigma that the expression “person with deficiency ”may mean for the right holder. To address an adequate definition requires the delimitation of the right holders; Therefore, the legal treatment of the fundamental rights of people with special needs in Brazil and Argentina, and particularly the duty of the State to ensure their inclusion in society, will be presented. The analysis will be especially carried out on rights that ensure the person with special needs quality of life and self-determination, which will only be possible from the seizure and adaptation of public and private spaces for coexistence open to all.

El objeto del presente trabajo analizar desde el prisma de la Convención Internacional sobre los Derechos de las Personas con Discapacidad su recepción en los ordenamientos jurídicos de Brasil y Argentina. En un primer momento será delimitada la terminología empleada en el trabajo, o sea, “persona con necesidades especiales”, lo que denota la ampliación del universo de las personas beneficiadas por la Convención, a fin de apartarse del estigma que la expresión “persona con deficiencia” puede significar para el titular del derecho. Para abordar una definición adecuada se requiere la delimitación de los titulares del derecho; por ello, será presentado el tratamiento jurídico de los derechos fundamentales de las personas con necesidades especiales en Brasil y Argentina, y particularmente el deber del Estado de asegurar su inclusión en la sociedad. El análisis será especialmente realizado sobre derechos que aseguren a la persona con necesidades especiales calidad de vida y autodeterminación, los cuales sólo serán posibles a partir del apoderamiento y de la adecuación de los espacios de convivencia públicos el privados abiertos a todos. O objetivo deste trabalho é analisar sua recepção nos ordenamentos jurídicos do Brasil e da Argentina a partir do prisma da Convenção Internacional sobre os Direitos das Pessoas com Deficiência. Num primeiro momento, será definida a terminologia utilizada no trabalho, ou seja, “pessoa com necessidades especiais”, o que denota a ampliação do universo de pessoas beneficiadas pela Convenção, a fim de tirar o estigma que a expressão “pessoa com deficiência” pode significar para o titular do direito. Para abordar uma definição adequada, é necessária a delimitação dos titulares de direitos; Para tanto, será apresentado o tratamento jurídico dos direitos fundamentais das pessoas com necessidades especiais no Brasil e na Argentina e, em particular, o dever do Estado de garantir sua inclusão na sociedade. A análise será feita especialmente sobre direitos que garantam à pessoa com necessidades especiais qualidade de vida e autodeterminação, que só será possível a partir da apreensão e adequação dos espaços públicos e privados de convivência abertos a todos.
