Resumo: Current analysis discusses the theme of objective civil responsibility on the environment, with special emphasis of the non-applicability of responsibility exclusion, with special attention to chance and greater force in oil spreading cases by ships as a basic fundamental right of the human person, basic to the Brazilian democratic state. The paper shows the basis by which one does not understand the excluding allegation and the consequences that would exist, especially in the denial of the principle of the dignity of the human person and fundamental right of the ecologically balanced environment.

The paper shows the basis by which one does not understand the excluding allegation and the consequences that would exist, especially in the denial of the principle of the dignity of the human person and fundamental right of the ecologically balanced environment.El presente trabajo tiene por objetivo discutir el tema de la responsabilidad civil en materia ambiental, con destaque especial a la no aplicabilidad de las excluyentes de responsabilidad, enfatizando el caso fortuito y fuerza mayor en situaciones de derramamiento de óleo por navíos, como medida básica fundamental para el respeto al principio de la dignidad de la persona humana, que es fundamento del Estado Democrático de Derecho brasileño. Desde esa perspectiva, se busca mostrar los fundamentos por los cuales se entiende que no es posible la alegación de las excluyentes y las consecuencias que existirían si caso así no fuera, especialmente en relación a la negación del principio de la dignidad de la persona humana y el derecho fundamental del medio ambiente ecológicamente equilibrado.O presente trabalho tem por escopo a discussão sobre a temática da responsabilidade civil objetiva em matéria ambiental, com enfoque especial à inaplicabilidade das excludentes de responsabilidade, com destaque do caso fortuito e força maior em casos de derramamento de óleo por navios, como medida básica fundamental para o respeito ao princípio da dignidade da pessoa humana, que é fundamento do Estado Democrático de Direito brasileiro.
