Resumo: This article aims to analyze the electoral litigation, specifically addressing the historical choice of the constituent to place the Electoral Justice1 as the competent body to intervene in the political process. It will also briefly analyze the judicialization of politics and the annulment of mandates, focusing on the absence of a firm doctrine and jurisprudence, especially with regard to the parameter of the severity of the conduct.

Este artículo tiene como objetivo analizar el litigio electoral, abordando específicamente la elección histórica del constituyente de colocar a la Justicia Electoral1 como órgano competente para intervenir en el proceso político. Se analizará brevemente, todavía, la judicialización de la política y la casación de los mandatos, centrándose en la ausencia de una doctrina y jurisprudencia firmes, especialmente en lo que se refiere al parámetro de la gravedad de la conducta.O presente artigo objetiva analisar o contencioso eleitoral, abordando especificamente a escolha histórica do constituinte de colocar a Justiça Eleitoral como órgão competente para intervir no processo político. Analisar-se-á, brevemente, ainda, a judicialização da política e a cassação dos mandatos, com enfoque na ausência de uma doutrina e jurisprudência firmes, especialmente no que concerne ao parâmetro da gravidade da conduta.
