Resumo: The present study focus the scope of injunctive relief (Article 273 of the Civil Procedure Code) under the effectiveness gore and procedure speed under the civil procedure and especially the work process, while the subsidiary application of the rules that branch is specialized in the not disposable, under Article 769 of the Labor Laws Code. Throughout this study analyzes there will be a judicial review from the effectiveness perspective, without losing focus concerning the analysis of the early relief technique and its indelible characteristics. There will be also a detailed study of injunctive relief in the general case theory lucidity, aiming to present their requirements and intrinsic and extrinsic factors assumptions, especially those common to the work process. Finally, analyzed will be the application of injunctive relief to the work process, highlighting its merits, with a view to achieving greater effectiveness and procedure speed.

Finally, analyzed will be the application of injunctive relief to the work process, highlighting its merits, with a view to achieving greater effectiveness and procedure speed.Ese estudio tiene como objetivo tratar de la tutela anticipada (Art. 273 del Código de Proceso Civil) desde la perspectiva de la efectividad y celeridad procesal en el ámbito del proceso civil y, sobretodo del proceso del trabajo, desde que la aplicación subsidiaria de las normas de aquella rama en el proceso especializado sea imposibilitada de eliminarse, por el Art. 769 de la CLT. A lo largo de ese estudio, será analizada la tutela jurisdiccional sob el prisma de la efectividad, sin la pérdida del foco concerniente al análisis de la técnica de anticipación de tutela y sus características propias. Desde esa perspectiva, se buscará, todavía, hacer un estudio pormenorizado de la tutela anticipada desde el punto de vista de la teoría general del proceso, objetivando presentar sus requisitos y presupuestos intrínsicos y extrínsecos, especialmente aquellos que son comunes al proceso de trabajo. Al fin, será analizada la aplicación de la tutela anticipada desde la perspectiva del proceso de trabajo, resaltando sus particularidades, para así, obtener más efectividad y celeridad procesal.O presente estudo tem por escopo enfocar a tutela antecipada (art. 273 do Código de Processo Civil) sob o viés da efetividade e celeridade processual no âmbito do processo civil e, sobretudo do processo do trabalho, conquanto a aplicação subsidiária das normas daquele ramo no processo especializado seja ineliminável, por força do art. 769 da CLT. Ao longo do presente estudo, analisar-se-á a tutela jurisdicional sob o ângulo da efetividade, sem perder o foco concernente à análise da técnica de antecipação de tutela e suas indeléveis características. Ver-se-á, ainda, um estudo pormenorizado da tutela antecipada à luz da teoria geral do processo, com o fito de apresentar seus requisitos e pressupostos intrínsecos e extrínsecos, especialmente aqueles comuns ao processo do trabalho.
