The Conflict Between the Right of Slab and the Guarantee of Quiet Enjoyment

Resumo: The present work deals with peace of mind as a personality right, highlighting the challenges of its guarantee in the Brazilian urbanistic scenario and emphasizing the most recent challenge posed by the positivization of slabs. The purpose of the research is to clarify the difficulties faced by the exercise of the right to quiet enjoyment, especially in informal urban settlements, analyzed from different perspectives, but concomitantly ratifying the existence of this guarantee to the persona. An analysis is made of the fact that the abstraction attributed to the fight against the disturbance of quiet enjoyment and the context in which this institute is inserted do not remove the credibility given to the spirit of man, which cannot be forgotten or compromised by the lack of planning and physical structure of the cities. The methodology used in the composition of this research is predominantly based on the theoretical study of doctrine, jurisprudence, and the impact caused by the change in the Civil Code with the introduction of the right of slab to the list of real rights.

El presente trabajo trata de la tranquilidad como derecho de la personalidad, destacando los desafíos de su protección en el escenario urbanístico brasileño y destacando el más reciente desafío establecido a partir de la positivización de las losas. El propósito de la investigación es esclarecer las dificultades que enfrenta el ejercicio del derecho a la tranquilidad, especialmente en las aglomeraciones urbanas informales, analizadas desde diferentes perspectivas, pero ratificando concomitantemente la existencia de esta garantía a la persona. Se hace un análisis de que la abstracción que se le da a la lucha contra la intranquilidad y el contexto en el que se inserta dicho instituto no quitan la credibilidad que se le da al espíritu del hombre, que no puede ser olvidado ni comprometido por la falta de planificación y estructura física de las ciudades. La metodología empleada en la composición de esta investigación se basa predominantemente en el estudio teórico de la doctrina, la jurisprudencia y el impacto que provocó el cambio en el Código Civil con la introducción del derecho de losa al listado de derechos reales. O presente trabalho trata do sossego como direito da personalidade, realçando os desafios de sua tutela no cenário urbanístico brasileiro e destacando o mais recente repto instaurado a partir da positivação das lajes. A finalidade da pesquisa é esclarecer as dificuldades que o exercício do direito ao sossego enfrenta, sobretudo em aglomerados urbanos informais, analisado em diferentes perspectivas, mas concomitantemente ratificar a existência dessa garantia à persona. Faz-se uma análise de que a abstração conferida ao combate do desassossego e o contexto em que tal instituto está inserido não retiram a credibilidade dada ao espírito do homem, que não pode ser esquecido ou comprometido pela falta de planejamento e de estrutura física das cidades.
