Resumo: | O State or civilized and modern Nation has a Constitution to support its scaffolding, whether institutionally or legally speaking. Also for other reasons that would exceed the subject matter. Every legal system prevails because it has as its basis a written document or instrument (in the case of formal constitutions, written character), which is endowed with force, value and validity over the rest of the rules (it is understood by constitutional supremacy) . From there it follows that the norms that are derived or spread by said order are those whose essential quality is to conform the fundamental right of organization of the State. Not only in terms of the material, but also in the formal, constitutional supremacy deals with its condition of formal predominance over the other legal norms that make up the legal system in question. It would not be absurd to call it the norm of norms, nor the law of laws, if we refer to its organizational function of the rule of law and its establishment within it as the supreme norm by the normative force of the Constitution itself. |

También por otros motivos que excederían el tema a tratar. Todo ordenamiento jurídico prevalece por tener como basamento un documento o instrumento escrito (en el caso de las constituciones formales, carácter escrito), el cual es dotado de fuerza, valor y vigencia por sobre el resto de las normas (se entiende por supremacía constitucional). De allí se desprende que las normas que se derivan o se esparcen por dicho ordenamiento son aquellas cuya cualidad esencial es la de conformar el derecho fundamental de organización del Estado. Ya no sólo en cuanto a lo material, sino en lo formal, la supremacía constitucional versa sobre su condición de predominio formal sobre las otras normas jurídicas que componen el ordenamiento jurídico que se trate. No sería absurdo llamarla norma de normas, ni ley de leyes, si nos referimos a su función organizativa del Estado de derecho y su señalamiento dentro del mismo como norma suprema por la propia fuerza normativa de la Constitución. O Estado ou nação civilizada e moderna tem uma Constituição para amparar seu andaime, seja institucional ou legalmente falando. Também por outros motivos que ultrapassariam o assunto em questão. Todo sistema jurídico prevalece porque tem por base um documento ou instrumento escrito (no caso das constituições formais, de caráter escrito), que é dotado de força, valor e validade sobre o resto das normas (entende-se por supremacia constitucional) . Daí decorre que as normas derivadas ou difundidas por essa ordem são aquelas cuja qualidade essencial é conformar o direito fundamental de organização do Estado. Não apenas no plano material, mas também no formal, a supremacia constitucional trata de sua condição de predomínio formal sobre as demais normas jurídicas que compõem o ordenamento jurídico em questão.
