Resumo: This paper aims at the study of personality rights and possibility of its application in the protection of the legal entity name. Initially, it is intended to analyze the legal entity, its historical evolution and the theories that try to justify its juridical nature. After that, we shall treat the personality rights, its different terminologies, its juridical nature and specifications, besides the legislative treatment of the matter, especially for the legal entity, in what it is applicable. Finally, the paper focuses on the protection of the legal entity name in the personality rights, including the right for reparation for moral damage.

Al inicio, se pretende analisar la persona jurídica, su evolución histórica y las teorías que buscan justificar su naturaleza jurídica. Enseguida, se va a tratar de los derechos de la personalidad, sus distintas terminologías, su naturaleza jurídica y especificaciones, además del tratamiento legislativo de la materia, especialmente para la persona jurídica, en lo que sea aplicable. La parte final del trabajo dispensará atención a la protección del nombre de la persona jurídica en el derecho de la personalidad, inclusive el derecho a la indenización por daños morales.O presente paper destina-se ao estudo dos direitos da personalidade e da possibilidade de sua aplicação na proteção do nome da pessoa jurídica. Inicialmente pretende-se analisar a pessoa jurídica, sua evolução histórica e as teorias que procuram justificar sua natureza jurídica. Em seguida, tratar-se-á dos direitos da personalidade, suas diferentes terminologias, sua natureza jurídica e especificações, além do tratamento legislativo da matéria, especialmente para a pessoa jurídica, no que lhe for aplicável.
