Collective Sentence and the Efficaciousness of Trans-Individual Rights

Resumo: The efficaciousness of trans-individual rights is a term that causes concern to contemporary jurists and legislators. Trans-individual rights are related to the rights of society as a whole and not to the rights of individuals as single subjects. Although these rights are substantially different, the traditional concept of juridical relationship have been employed to control them. Since the latter is proper to individual rights, the inefficaciousness of these rights has emerged. Due to their specific nature, legislation changes have been undertaken to provide a better efficaciousness to trans-individual rights. Within the specificities of the above-mentioned rights, objects of alterations, those referring to collective sentences and to several modalities of sentence execution may be encountered. Greater efficaciousness to trans-individual right has been obtained through greater specificity.

Os direitos transindividuais relacionam-se a direitos de uma sociedade em massa, não a interesses concernentes apenas a indivíduos, entendido em sua singularidade. Embora tais direitos possuam naturezas diversas, tem-se utilizado a concepção tradicional de relação jurídica para discipliná-los, própria dos direitos individuais, o que tem gerado a inefetividade desses direitos. Algumas alterações legislativas foram realizadas com a finalidade de proporcionar maior efetividade aos direitos transindividuais, dada a sua natureza peculiar. Dentre as peculiaridades desses direitos que foram objeto de tratativa pelas mencionadas alterações, encontram-se as referentes à sentença coletiva e às diversas modalidades de execução de sentença.
