Equal Salaries: Analysis of the Function Identity Criterion from the Point of Fordism and Toyotism Point of View

Resumo: | The predominant concept in labor jurisprudence to define function identity – the presupposition for the acknowledgement of equal salaries as conceived in Art 461 of the Brazilian Labor Law (CLT) – is foregrounded on the fact that employees with equal salaries should develop identical tasks. The criterion is derived from the hegemonic concept of the 100-year-old Ford production system in which workers normally developed the same set of tasks throughout their labor contract, coupled to adherence to strict hierarchic stratification. However, the rise of Toyotism brought forth more flexible tasks and functions with decision-taking and immediate problem solving. The strictly Ford system states that no two employees should have the same task and functions are identified through the finality of the tasks and attributions undertaken by the workers. The employment of the Ford system within an organized firm as from the point of view of Toyotism causes deep concern and is an offense to the principle of equality in salaries. |

Este criterio deriva de la hegemonía del sistema fordista de producción por casi un siglo, donde el trabajador normalmente desarrolla el mismo conjunto de tareas a lo largo del contracto, teniendo en vista rígido sistema jerárquico. Sin embargo, con el surgimiento del toyotismo, se pasó a exigirse de los empleados tareas y atribuciones más flexibles, pudiendo tomar decisiones y resolver problemas inmediatos. Así que, en el sistema fordista, a principio, ningún empleado ejerce rigurosamente las mismas tareas que el otro, siendo las funciones identificadas por la finalidad del conjunto de tareas y atribuciones realizadas por los empleados. La utilización del criterio concebido teniendo en vista el sistema fordista en situación de empresa organizadas a partir del sistema toyotista genera profundas iniquidades, con agravios al principio de equidad de sueldos.O entendimento dominante na jurisprudência trabalhista para efeito de se conceituar identidade de função – pressuposto para reconhecimento da equiparação salarial prevista no art. 461 da CLT - é o de que os empregados equiparados devem desenvolver identidade absoluta de tarefas. Este critério decorre da hegemonia do sistema fordista de produção por quase um século, onde o trabalhador normalmente desenvolve o mesmo conjunto de tarefas ao longo do contrato, tendo em vista rígido sistema hierárquico. No entanto, com o surgimento do toyotismo, passou-se a se exigir dos empregados tarefas e atribuições mais flexíveis, podendo tomar decisões e resolver problemas imediatos. Assim, no sistema fordista, a rigor, nenhum empregado exerce rigorosamente as mesmas tarefas que outro, sendo as funções identificadas pela finalidade do conjunto de tarefas e atribuições realizadas pelos empregados.
