A clonagem humana, suas características éticas e jurídicas

Resumo: The present paper aims to expose the practice of human cloning that derives from reproductive cloning as well as therapeutic cloning, exposing its techniques as well as the tangent to ethics related to such practices. With a historical analysis of the development of science behind the techniques that involve cloning, the growth of science is observed and the need for legal and legal monitoring regarding human cloning is analyzed. The bioethics present in this work is linked to the legal aspects of the theme presented in it. The presence of the Biosafety Law in Brazil stimulates the legal discussion involving the science of human clones, presenting, as the main focus of such discussion, the protection of the fundamental principle of human dignity. It is also observed, in this article, the history of the evolution of research with human cells and embryos.

Com uma análise histórica do desenvolvimento da ciência por trás das técnicas que envolvem a realização da clonagem, observa-se o crescimento da ciência e analisa-se a necessidade do acompanhamento jurídico e legal a respeito da clonagem humana. A bioética presente neste trabalho interliga-se aos aspectos jurídicos do tema nele apresentados. A presença da Lei da Biossegurança no Brasil impulsiona a discussão jurídica que envolve a ciência dos clones humanos, apresentando, como foco principal de tal discussão, o resguardo do princípio fundamental da dignidade da pessoa humana.
