Resumo: The maintenance and administration of the prison system in Brazil is the responsibility of the State. However, in recent years, there are several problems faced in the fulfillment of the custodial sentence, evidencing an affront to the minimum rights of detainees. This article reflects on the privatization of the Brazilian prison system as an alternative to the main problems of prison. Thus, we seek to understand the possibility of changing to a privatized model and, consequently, a new proposal for penitentiary management, and the reflexes in the realization of prisoners' rights. The research is classified as qualitative, descriptive and bibliographic. It appears that the international experience, and the results achieved in the privatized units in Brazil, show good results in terms of the realization of the minimum rights of the convicts when compared to the traditional model of penitentiary management, especially regarding the assistance to the detainees and the observance of the fundamental rights, such as work, health, education, among others.

Porém, nos últimos anos, vários são os problemas enfrentados no cumprimento da pena privativa de liberdade, evidenciando afronta aos direitos mínimos dos detentos. O presente artigo tem por refletir sobre a privatização do sistema prisional brasileiro como alternativa aos principais problemas do cárcere. Assim, busca-se compreender a possibilidade de mudança para um modelo privatizado e, consequentemente, uma nova proposta de gestão penitenciária, e os reflexos na efetivação dos direitos dos presos. A pesquisa classifica-se como qualitativa, descritiva e bibliográfica.
