Resumo: The scenario of prisons in Brazil has left a lot to be desired in terms of quality for several reasons, and currently, much has been discussed about this issue. Despite the poor health inside the cells is one of the main items of concern for both family members who have loved ones in the system, as well as the authorities responsible for remembering the pandemic that we are living, which can be observed in the very Law of penal execution (Law No. 7.210/1984) in its art. 10 assistance to the prisoner is the State's duty, specifically his health. Moreover, the media has always been based on overcrowding when talking about Brazilian prisons, because according to data from National Penitentiary Department (Depen), Brazil currently has about 678,506 prisoners without electronic monitoring, which ends up having a lack of 231,768 vacancies in the system, thus occurring, cells with a capacity far beyond what is established in the Penitentiary Statute of the State of Paraná, which brings in document in arts. 20 §ú and 33 the convicted will be housed in individual cells and the provision of individual bedding and comfort. Thus, the present work, based on a literature review and an analysis of the country's prison system, seeks to portray the real situation of prisoners today.

A despeito sobre a saúde precária dentro das celas é um dos principais itens de preocupação tanto de familiares que possuem entes no sistema, como também das autoridades responsáveis, por se lembrar da pandemia que estamos vivendo, na qual pode ser observado, na própria Lei de execução penal (Lei n. 7.210/1984) em seu art. 10 a assistência ao preso é dever do Estado, em específico à sua saúde. Ademais, a mídia tem sempre se baseado na superlotação quando se fala sobre os presídios brasileiros, pois conforme os dados levantados no primeiro semestre de 2020 do Departamento penitenciário nacional (Depen), atualmente, o Brasil possui cerca de 678.506 presos sem o monitoramento eletrônico, no qual acaba tendo uma falta de 231.768 vagas no sistema, ocorrendo, assim, celas com a capacidade muito além da qual é estabelecida no Estatuto Penitenciário do Estado do Paraná, que traz em documento nos arts. 20 parágrafo único e 33 o condenado será alojado em cela individual e o fornecimento de cama individual e conforto.
