Resumo: This article aims at a critical and legal analysis of the guarantee of fundamental rights and their basic principles, provided for by the Federal Constitution of 1988 and by the Organic Health Law 8.080 / 90, emphasizing the realization of the right to health, regarding the availability of medicines . The work was developed through jurisprudential, doctrinal and legislative research, aiming, as an objective, to clarify and understand the judicialization process, its procedure and established jurisprudential guidelines, regarding the joint and several liability of the federal entities, their repercussions and disadvantages. Thus, guarantees and fundamental principles were analyzed in order to clarify joint and several liability, with an understanding of the budgetary limits of the possible reserve, seeking to study the judicial progression and guarantee for the realization of this right.

O trabalho foi desenvolvido por meio de pesquisa jurisprudencial, doutrinaria e legislativa, visando, como objetivo, o esclarecimento e a compreensão do processo de judicialização, seu procedimento e as diretrizes jurisprudenciais estabelecidas, quanto à responsabilidade solidária dos entes federativos, suas repercussões e desvantagens.
