Resumo: The current Brazilian legislation has a gap regarding the retirement of transgender people, this fact creates juridical insecurity and can result in the violation of the rights of this group of people, which goes directly against the purpose of Social Security, which is to protect and care for the social well-being and reduce inequality. The objective of the article is to research in legislation, doctrine and especially jurisprudence what is the understanding that should be applied to possible controversies that may exist, as well as whether there are other doctrinal currents regarding the granting of this benefit. The methodology that was used to understand the possible solutions to this legislative void was bibliographical research trying to demonstrate in the best way possible the relevant doctrinal theories.

The methodology that was used to understand the possible solutions to this legislative void was bibliographical research trying to demonstrate in the best way possible the relevant doctrinal theories.A legislação brasileira atual possui uma lacuna quanto a aposentadoria de pessoas transexuais, tal fato gera uma insegurança jurídica e pode resultar na violação de direitos desse grupo de pessoas, o que vai diretamente contra o propósito da Previdência Social que é o de proteger, cuidar do bem-estar social e reduzir a desigualdade. O objetivo do artigo é pesquisar na legislação, doutrina e principalmente na jurisprudência qual é o entendimento que deverá ser aplicado a possíveis controvérsias que poderão existir, bem como se existem outras correntes doutrinárias acerca da concessão desse benefício.
