O quadro em que se apresenta a floresta paranaense e, consequentemente, toda a diversidade que a envolve, demonstra a urgência em se preservar o que pode ainda ser salvo. A necessidade de se conduzir ações rápidas e ordenadas com o intuito de defender as espécies que a compõem, avaliando os impactos das atividades humanas na natureza. A Reserva Florestal Legal é um instituto do Direito Ambiental, com natureza jurídica de limitação administrativa, imposta de maneira geral pelo Poder Público e de forma gratuita, visando proteger e criar repositórios da flora e da fauna, e conservar a biodiversidade. O objetivo principal é demonstrar a flexibilidade do direito de propriedade diante da nova Ordem Social apresentada pela Constituição Federal de 1988, destacando as prerrogativas e os benefícios para se implementar a Reserva Florestal Legal (RFL) e as possibilidades de aproveitamento econômico da área. Numa abordagem, em termos gerais, discute-se sobre o que vem a ser Reserva Florestal Legal, enfatiza sua situação no Estado do Paraná e, na sequência, analisa-se os benefícios e as alternativas que a lei estende de forma específica ao instituto da Reserva Florestal Legal, apontando diferentes possibilidades de se auferir lucro e utilizá-la economicamente dentro da noção de “desenvolvimento sustentável”. Dessa maneira, configura-se que a Reserva Legal se adapta à necessidade de se observar a função social da propriedade. Ocorre que a proteção ao meio ambiente e a busca por esses interesses se contrapõem a um dos mais sólidos direitos que existe nas sociedades civilizadas desde os seus primórdios, o Direito de Propriedade. Assim sendo, inúmeras são as limitações que recaem hoje sobre o direito de propriedade, buscando atender sempre sua função social. Importante pois, tal análise das características deste instituto para entender como se manifesta no mundo fático e quais são as alternativas e benefícios que flexibilizaram a implementação da Reserva Florestal Legal, assim como estabelece algumas possibilidades de uso econômico.Abstract The present situation in Paraná State Forest, demands the urgency of developing actions in order to defend the species, evaluating the human actions impact in the nature. The Legal Forest Reserve is a legal environmental institute, but with administrative limitations imposed by the Public Power, aiming to protect and create fauna and flora repositories to conserve biodiversity. This work intends to demonstrate the property right flexibility established by the new social order presented by the Federal Constitution of 1988, showing the benefi ts of implanting a Legal Forest Reserve and it`s economic use. In general terms, this research discusses a Legal Forest Reserve, emphasizing it`s situation in Paraná State, analyzing the benefi ts and alternatives proposed by the specific law for Legal Forest Reserves, and showing different ways to have profits from it by the use in a economic perspective based in “sustainable development”. In this way, there is a relation with legal reserve and the necessity to observe the property’s social function. There is an opposition in nature protection and property right. In short, there are many limitations on property right, concerning its social function. It’s important to analyze the characteristics of this institution to understand how it manifests itself and which are the fl exible alternatives and benefits to implant a Legal Forest Reserve and its economical possibilities of use.
