Resumo: The present work intends to analyze the concretion of the fundamental rights – mainly the social ones –, constitutionally assured, by the implementation of public policies. For such, an historical view is used to subsidize the normativity and social effectiveness of the fundamental rights, guiding – through a historical analysis of the issue – to a State that works by positive acts, as a form to reach a regular social order, whose leading position, in this framework, is extracted from the Constitution.
