The Juridical Germanistic and the accusatory finger metaphor in the exploratory context of fundamental rights dogmatic

Resumo: The paper somewhat suggests that the dogmatic of the constitutional rights could be more strongly linked to a historical factor, relatated to the second great war, and its outcome, as opposed to a traditional conception that suggests an evolutionary unfolding. The paper suggests some strong links between the human rights agenda and the nazi’s atrocities. In that sense, the paper explores the problem of guilty in the context of the institutional arrangements that followed the subsequent German framework in the scope of human rights protection.
