Host institutions in compliance with the principle of exceptionality

Resumo: This article deals with the institutionalization and care process, which was changed after the creation of the Child and Adolescent Statute (ECA) and the Adoption Law, making institutional care a protective measure in order to prevent the rights of children and adolescents are violated. For many years, the situation of these subjects was totally different, they applied correction and punishment measures, taking into account poverty. However, with the emergence of new laws, full protection was instituted, being the duty of the family, society and the State to guarantee absolute priority regardless of the social class to which they belong. In addition, institutional care must be exceptional and temporary, bearing in mind that the child or adolescent can only be removed from the family and social life, after all possible measures have been used. Removal from family life should be a rare measure, preventing developmental damage caused by separation. From this, the objective was to carry out a study on the aspects of exceptionality and provisionality in situations of child and adolescent care, in compliance with the principle of full protection. In order to achieve this objective, the deductive and explanatory method was used through a qualitative bibliographic research. Finally, it is considered that there is a failure to observe the fundamental rights of the child/adolescent and the principles of exceptionality and provisionality, hurting what is intended as the main objective, that is, family life and full development.

Durante muchos años, la situación de estos sujetos fue totalmente diferente, aplicaron medidas de corrección y castigo, tomando en cuenta la pobreza. Sin embargo, con la aparición de nuevas leyes se instituyó la protección plena, siendo deber de la familia, la sociedad y el Estado garantizar la prioridad absoluta independientemente de la clase social a la que pertenezcan. Además, la atención institucional debe ser excepcional y temporal, teniendo en cuenta que el niño, niña o adolescente solo puede ser alejado de la vida familiar, después de que se hayan tomado todas las medidas posibles. La separación de la vida familiar debería ser una medida poco común que prevenga el daño al desarrollo causado por la separación. A partir de ello, el objetivo fue realizar un estudio sobre los aspectos de excepcionalidad y provisionalidad en situaciones de atención a la niñez y adolescencia, en cumplimiento del principio de protección integral. Para lograr este objetivo se utilizó el método deductivo y explicativo mediante una investigación bibliográfica cualitativa. Finalmente, se considera que existe un incumplimiento de los derechos fundamentales del joven y los principios de excepcionalidad y provisionalidad, perjudicando lo que se pretende como objetivo principal, es decir, la vida familiar y pleno desarrollo.O presente artigo versa sobre o processo de institucionalização e acolhimento, que foi alterado após a criação do Estatuto da Criança e Adolescente (ECA) e da Lei de Adoção tornando o acolhimento institucional uma medida protetiva com objetivo de evitar que os direitos das crianças e adolescentes sejam violados. Durante muitos anos, a situação desses sujeitos era totalmente diferente, aplicavam medidas de correção e punição, levando em consideração a pobreza. Contudo, com o surgimento de novas leis, se instituiu a proteção integral, sendo dever da família, da sociedade e do Estado garantir prioridade absoluta independente da classe social em que pertença. Além disso, o acolhimento institucional deverá se dar em caráter de excepcionalidade e provisoriedade, tendo em vista que a criança ou adolescente só poderá ser afastado da família e do convívio social, após serem utilizadas todas as medidas possíveis. O afastamento do convívio familiar deverá ser uma medida rara, evitando danos ao desenvolvimento causados por separações. A partir disso, objetivou-se realizar um estudo sobre os aspectos da excepcionalidade e da provisoriedade em situações de acolhimento de crianças e adolescentes em observância ao princípio da proteção integral. Para que se atinja esse objetivo, foi utilizado o método dedutivo, explicativo e através de uma pesquisa qualitativa do tipo bibliográfica.
