Technological patenting prospecting of food products with Cannabis sativa or cannabidiol (CBD) addition

Resumo: | The new policies to release recreational cannabis use in recent decades have increased the use in food. As it is a relatively new and promising market, patent protection is necessary. This manuscript aimed to map patent technologies regarding the addition of cannabis or cannabidiol to food products, with the purpose of verifying technological advances and national and international market trends. A documentary research was carried out, through patent documents, in the INPI electronic database and with the aid of the ORBIT® software, from Questel. It was possible to verify an increase in the number of deposits from 2012, indicating that the release of recreational use has heated up the study and development of technology. It was observed that, both nationally and globally, the main patent filers are private companies and that most of the patents deposited are defined as active. This shows how incipient the technology is and promises great innovations. The protection of these patents occurs mostly in China, the United States and Canada. |

Dado que es un mercado relativamente nuevo y prometedor, la protección por patente es muy necesaria. Este trabajo tuvo como objetivo mapear las tecnologías patentadas relacionadas con la adición de cannabis o cannabidiol en productos alimenticios, con el objetivo de verificar los avances tecnológicos y las tendencias del mercado a nivel nacional e internacional. Se realizó una búsqueda documental, a través de documentos de patente, en la base de datos electrónica del INPI y el software ORBIT®, de Questel. Se pudo ver un aumento en la cantidad de depósitos desde 2012, lo que demuestra que la liberación de uso recreativo ha impulsado el estudio y desarrollo de tecnología. Se observó que, tanto a nivel nacional como global, los principales solicitantes de patentes son empresas privadas y que la mayoría de las patentes depositadas están activas. Esto muestra cómo la tecnología incipiente es y promete grandes novedades. Estas patentes fueron protegidos en su mayoría en China, Estados Unidos y Canadá.As novas políticas de liberação do uso da cannabis de forma recreativa nas últimas décadas, vêm desencadeado uma grande movimentação a respeito do seu uso em alimentos. Por ser um mercado relativamente novo e promissor, a proteção patentária se mostra bastante necessária. Este trabalho objetivou mapear as tecnologias patentárias a respeito da adição de cannabis ou canabidiol em produtos alimentícios, a fim de verificar os avanços tecnológicos e tendências mercadológicas em nível nacional e internacional. Foi realizada uma pesquisa documental, através de documentos de patentes, na base de dados eletrônica do INPI e o software ORBIT®, da empresa Questel. Foi possível verificar um aumento no número dos depósitos a partir de 2012, mostrando que a liberação do uso recreativo impulsionou o estudo e desenvolvimento da tecnologia. Observou-se que, tanto no cenário nacional quanto mundial, os principais depositantes de patentes são empresas privadas e que a maior parte das patentes depositadas, encontram-se ativas. Isso mostra o quanto a tecnologia é incipiente e promete grandes inovações.
