Advances and challenges of the right to education in the brazilian prison system

Resumo: Education constituted itself as a privilege of the few, becoming a fundamental right in the 1988 Constitution. In the prison context, only from 2011 it became a right to re-sentence, after many years of processing the bill in the National Congress. Data from the survey of penitentiary information reveal that more than half, that is, 60.38% of the prison population has low schooling and only 10.58% are enrolled in some educational activity. Therefore, the aim of this study was to promote a theoretical reflection on the right to education in the Brazilian prison system, for this purpose made use with bibliographic review and consulted the main norms that deal with education in the prison environment. Thus, it was possible to correlate that, despite recent normative advances, the supply and access to education in prison faces many challenges, including the way it has been developed, being related to the political wills of each government; and, also, the understanding of society and prison managers who see education as a privilege opposing a right that is independent of the condition of deprivation of liberty.

En el contexto penitenciario, sólo a partir de 2011 se convirtió en un derecho a volver a sentenciar, después de muchos años de tramitar el proyecto de ley en el Congreso Nacional. Los datos de la encuesta de información penitenciaria revelan que más de la mitad, es decir, el 60,38% de la población carcelaria tiene poca escolaridad y solo el 10,58% está matriculada en alguna actividad educativa. Por lo tanto, el objetivo de este estudio fue promover una reflexión teórica sobre el derecho a la educación en el sistema penitenciario brasileño, para ello se hizo uso con revisión bibliográfica y se consultaron las principales normas que se ocupan de la educación en el entorno penitenciario. Por lo tanto, era posible correlacionar que, a pesar de los recientes avances normativos, la oferta y el acceso a la educación en la prisión se enfrentan a muchos desafíos, incluida la forma en que se ha desarrollado, relacionados con las voluntades políticas de cada gobierno; y, también, la comprensión de la sociedad y de los administradores de prisiones que ven la educación como un privilegio opuesto a un derecho que es independiente de la condición de privación de libertad.A educação constituiu-se como um privilégio de poucos, tornando se direito fundamental na Constituição de 1988. Já no âmbito prisional, somente a partir de 2011 ela se tornou um direito de remição da pena, depois de muitos anos de tramitação do projeto de Lei no Congresso Nacional. Dados do levantamento de informações penitenciarias revelam que mais da metade, ou seja, 60,38% da população carcerária possui baixa escolaridade e apenas 10,58% estão inseridos em alguma atividade educacional. Diante disso, o objetivo deste estudo foi promover uma reflexão teórica sobre o direito à educação no sistema prisional brasileiro, para tanto fez uso com revisão bibliográfica e consultou as principais normas que versam sobre a educação no âmbito prisional.
