The history and investigative powers of congressional investigations: fundamental configuration and relevant aspects of the institute in Brazil

Resumo: The present work aims to understand the legal nature of the Parliamentary Inquiry Commissions, in addition to indicating their various limits, given the considerable importance of the institute in the maintenance of the Democratic State of Law. Throughout the text, the institute's relationship with the theory of the tripartition of powers is developed, its origin in English law, the configuration of the institute throughout the various Brazilian constitutional laws, the requirements for its establishment, in addition to the limits applied to its investigative instructive powers. Furthermore, the method of hypothetical-deductive approach and auxiliary historical-comparative methods, applied research and qualitative exploratory analysis were used. The purpose of the research is a formative evaluation with a bibliographic research technique and a case study. Finally, it is concluded that the institute is essential for the maintenance of the checks and balances regime, but it needs a more detailed legislative treatment, in order to prevent possible usurpations of powers or deviations of purpose, especially with regard to the law silence, management of breach of confidentiality, handling of illicit evidence and the use of plea bargains.

A lo largo del texto se desarrolla la relación del instituto con la teoría de la tripartición de poderes, su origen en el derecho inglés, la configuración del instituto a lo largo de las diversas leyes constitucionales brasileñas, los requisitos para su establecimiento, además de los límites aplicados a su facultades instructivas investigativas. Además, se utilizó el método de enfoque hipotético-deductivo y métodos auxiliares histórico-comparativos, investigación aplicada y análisis exploratorio cualitativo. El propósito de la investigación es una evaluación formativa con una técnica de investigación bibliográfica y un estudio de caso. Finalmente, se concluye que el instituto es fundamental para el mantenimiento del régimen de pesos y contrapesos, pero necesita un tratamiento legislativo más detallado, a fin de prevenir posibles usurpaciones de facultades o desviaciones de propósito, especialmente en lo que respecta al silencio de la ley, la gestión de la violación de la confidencialidad, el manejo de pruebas ilícitas y el uso de acuerdos de culpabilidad.O presente trabalho tem por finalidade compreender a natureza jurídica das Comissões Parlamentares de Inquérito, além de indicar os seus diversos limites, haja vista a considerável relevância do instituto na manutenção do Estado Democrático de Direito. Ao longo do texto, desenvolve-se a relação do instituto com a teoria da tripartição dos poderes, a sua origem no direito inglês, a configuração do instituto ao longo das diversas constitucionais brasileiras, os requisitos para a instauração, além dos limites aplicados aos seus poderes instrutórios de investigação. Ademais, foi utilizado o método de abordagem hipotético-dedutivo e métodos auxiliares histórico-comparativo, pesquisa aplicada e qualitativa de análise exploratória. O propósito da pesquisa é de avaliação formativa com técnica de pesquisa bibliográfica e estudo de caso.
