The need for state intervention to protect small businesses as one of the measures to overcome unemployment caused by the 2008 economic crisis

Resumo: | This research work analyzes the need for state intervention to protect small businesses as one of the measures to overcome unemployment caused by economic crises, especially the one that broke out in 2008. In Brazil, there are currently about 6.4 millions of commercial establishments. Of this total, 99% are small companies, accounting for 52% of formal jobs in the private sector. However, despite its unquestionable importance, we must highlight its low survival rate, on average 58% compared to small companies with up to 2 years. We will verify the role and the limits of the State's action in times of crisis and in the protection of this under-sufficient segment, passing through the analysis of the premise that economic growth is a sufficient condition for achieving development and overcoming high unemployment rates. To respond to the problems raised, historicity will be used to verify the increase in the rate of entrepreneurship after the outbreak of the 2008 crisis, also using the economic analysis of law in an attempt to situate the need for state action in promoting and implementing different legal treatment of these categories. Finally, it is hypothesized whether the implementation of the constitutional principle of differentiated treatment of small businesses can be used as one of the tools to combat unemployment in times of economic crisis. |

En Brasil, actualmente hay alrededor de 6,4 millones de establecimientos comerciales. De este total, el 99% son pequeñas empresas, que representan el 52% de los empleos formales en el sector privado. Sin embargo, a pesar de su incuestionable importancia, hay que destacar su baja tasa de supervivencia, en promedio un 58% en comparación con las pequeñas empresas con hasta 2 años. Verificaremos el papel y los límites de la acción del Estado en tiempos de crisis y en la protección de este segmento insuficiente, pasando por el análisis de la premisa de que el crecimiento económico es condición suficiente para lograr el desarrollo y superar altas tasas de desempleo. Para dar respuesta a los problemas planteados, se utilizará la historicidad para verificar el aumento de la tasa de emprendimiento tras el estallido de la crisis de 2008, utilizando también el análisis económico del derecho en un intento de situar la necesidad de la acción estatal en la promoción e implementación de diferentes tratamiento legal de estas categorías. Finalmente, se plantea la hipótesis de si la implementación del principio constitucional de trato diferenciado de las pequeñas empresas puede utilizarse como una de las herramientas para combatir el desempleo en tiempos de crisis económica.Este trabalho de pesquisa trata da análise da necessidade de intervenção estatal para a proteção das pequenas empresas como uma das medidas de superação do desemprego ocasionado pelas crises econômicas, em especial a que eclodiu em 2008. No Brasil, atualmente, existem cerca de 6,4 milhões de estabelecimentos comerciais. Desse total, 99% são pequenas empresas, respondendo por 52% dos empregos formais do setor privado. Todavia, apesar da sua inquestionável importância, devemos destacar a sua baixa taxa de sobrevivência, em média 58% em relação às pequenas empresas com até 2 anos. Verificaremos o papel e quais os limites de atuação do Estado em épocas de crises e na proteção desse seguimento hipossuficiente passando pela análise da premissa de que o crescimento econômico é condição suficiente para o alcance do desenvolvimento e para a superação das altas taxas de desemprego. Para responder aos problemas levantados, utilizar-se-á a historicidade para a verificação do aumento da taxa de empreendedorismo após a eclosão da crise de 2008, utilizando ainda a análise econômica do direito na tentativa de situar a necessidade de atuação estatal na promoção e efetivação do tratamento jurídico diferenciado a essas categorias.
