Labor Agreements - Employee and boss: A brief discussion of labor reform and the hidden danger behind agreements

Resumo: | The work category has undergone profound transformations since the last decades of the twentieth century, especially since 1995 under the government of Fernando Henrique Cardoso. In this, capital has been restructured from neoliberalist politics, which saw in the work the opportunity to broaden its eagerness for more profit; now, far beyond gaining profits on the strength of the proletariat, the quest is for new conditions to make the worker even more submissive. The labor reform, Law No. 13467, made official in 2017, brought the possibility of collective agreements; supposedly, a form of negotiation between employer and employee. The aim of the research is to reveal the worker's situation in the face of such changes and to outline the risks hidden in the new labor laws. This research is a case study with a bibliographical, methodological and qualitative approach. Based on a bibliographical research, the work sought to base its theme through the thought of renowned authors, as well as in laws so that one can have the clarity of what this labor reform is and its possible consequences. It was concluded that labor agreements are a great trap, where the worker is forced to make changes in his life, so that he is not outside the labor market and although the injury to the worker occurs, among other things, the instability in your service station. |

En eso, el capital viene siendo reestructurado a partir de la política neoliberalista, que vio en el trabajo la oportunidad de ampliar su ansia por más ganancia; ahora, mucho más allá de adquirir ganancias sobre la fuerza del proletariado, la búsqueda es por nuevas condiciones de hacer el trabajador aún más sumiso. La reforma laboral, ley N ° 13.467, oficializada en 2017, trae la posibilidad de acuerdos colectivos; supuestamente, una forma de negociación entre patrón y empleado. El objetivo de la investigación es revelar la situación del trabajador ante estos cambios y delinear los riesgos escondidos en las nuevas leyes laborales. Esta investigación se trata de un estudio de caso, con un abordaje bibliográfico, metodológico y cualitativo. El trabajo buscó basar su temática a través del pensamiento de autores renombrados, así como en leyes para que se tenga la claridad de lo que es esta reforma laboral y sus posibles consecuencias. Se concluyó que los acuerdos laborales es una gran trampa, donde el trabajador está obligado a asumir cambios en su vida, para que no quede fuera del mercado de trabajo y aunque el perjuicio al trabajador se da, entre otras cosas, por la inestabilidad en su puesto de servicio.A categoria trabalho vem passando por profundas transformações desde as ultimas décadas do século XX, principalmente a partir de 1995, no governo de Fernando Henrique Cardoso. Nisso, o capital vem sendo reestruturado a partir da politica neoliberalista, que viu no trabalho a oportunidade de ampliar sua ânsia por mais lucro; agora, muito além de adquiri lucros em cima da força do proletariado, a busca é por novas condições de tornar o trabalhador ainda mais submisso. A reforma trabalhista, lei N°13.467, oficializada em 2017, trouxe a possibilidade de acordos coletivos; supostamente, uma forma de negociação entre patrão e empregado. O objetivo da pesquisa é revelar a situação do trabalhador diante de tais mudanças e delinear os riscos escondidos nas novas leis trabalhistas. Esta pesquisa trata-se de um estudo de caso, com uma abordagem bibliográfica, metodológica e qualitativa. Realizado através de pesquisa bibliográfica, o trabalho procurou basear sua temática através do pensamento de autores renomados, bem como em leis para que se tenha a clareza do que é esta reforma trabalhista e suas possíveis consequências.
