Article 8º, Section IX of the Maria da Penha Law: utopia or a real possibility of application in the school context?

Resumo: The purpose of this article is to discuss the effectiveness of article 8, section IX of the Maria da Penha Law, which emphasizes "the emphasis in curriculum at all levels of education on contents related to human rights, gender equity and of race or ethnicity, and to the problem of domestic and family violence against women.”(Brazil, 2006) This approach was based on bibliographical research, expressing great relevance due to the increasing cases of gender violence throughout the country ratifying the need to rethink solutions to the problem presented. Faced with these issues, it is concluded that despite all social and legal developments regarding the creation of mechanisms to curb gender violence, the gaps that prevent greater effectiveness in the application of article 8, section IX of the Maria da Penha Law in schools, requiring more precise actions on the part of the public power.

"(Brasil, 2006) Este enfoque se dio por medio de investigación bibliográfica, expresando ser de gran relevancia en razón de los crecientes casos de violencia de género en todo el mundo país, ratificando la necesidad de repensar soluciones para el problema presentado. Ante estas cuestiones, se concluye que a pesar de toda evolución social y jurídica en lo que se refiere a la creación de mecanismos para cohibir la violencia de género, todavía son notorias las lagunas que impiden una mayor efectividad en cuanto a la aplicación del artículo 8, inciso IX de la Ley Maria da Penha en las escuelas, siendo necesarias acciones más precisas por parte del poder público.O presente artigo tem por objetivo discutir sobre a efetividade do artigo 8º, inciso IX da Lei Maria da Penha, que ressalta “o destaque, nos currículos escolares de todos os níveis de ensino, para os conteúdos relativos aos direitos humanos, à eqüidade de gênero e de raça ou etnia e ao problema da violência doméstica e familiar contra a mulher.” (Brasil, 2006) Esta abordagem se deu por meio de pesquisa bibliográfica, expressando ser de grande relevância em razão dos crescentes casos de violência de gênero em todo o país, ratificando a necessidade de repensar soluções para o problema apresentado.
