Analysis of the legal treatment of human conscience: reflections on Brazilian constitutionalism

Resumo: Conscientious objection protects the principle of respect for full and conscious autonomy and freedom, which is among the fundamental rights provided for in the Brazilian Federal Constitution of 1988, however, it is common for the matter to be absorbed by legal and civil society, due to of a certain lack of knowledge on the part of the operators of the law and the difficulty of implementation on the part of the State. Conscientious objection could be summarized concisely as a conscious non-adherence to a certain norm or act due to the conscience of the individual. However, the question is: Would it be acceptable for someone, based on their own principles, to harm another person? Can someone be forced to act in a certain way, even if it is against their values ​​to the detriment of the well-being of others? In this way, the main objective of this study is summarized in pointing out the access to the right of conscientious objection in Brazil, as well as demonstrating in the light of bioethics and law, the meaning given by the legal system to the institute, seeking to reach a conclusion about of the most correct position to be taken by the State in the face of a possible conflict of fundamental principles and rights. It is concluded that the objection cannot be based on personal whims, so that the reasons are proportional to the values discussed, and that the objector is willing to have a possible dialogue seeking an efficient or less burdensome solution, thus seeking to ensure that the objection does not conflict with the rights of other individuals, especially with regard to the right to life.

La objeción de conciencia se podría resumir de manera concisa como una no adhesión consciente a determinada norma o acto debido a la conciencia del individuo. Sin embargo, la pregunta es: ¿Sería aceptable que alguien, basado en sus propios principios, dañe a otra persona? ¿Se puede obligar a alguien a actuar de determinada manera, aunque sea en contra de sus valores en detrimento del bienestar de los demás? De esta forma, el objetivo principal de este estudio se resume en señalar el acceso al derecho de objeción de conciencia en Brasil, así como demostrar a la luz de la bioética y del derecho, el significado que el ordenamiento jurídico otorga al instituto, buscando llegar a una conclusión acerca de la posición más correcta a tomar por parte del Estado ante un posible conflicto de principios y derechos fundamentales. Se concluye que la objeción no puede basarse en caprichos personales, de modo que las razones sean proporcionales a los valores discutidos, y que el objetante esté dispuesto a tener un posible diálogo buscando una solución eficiente o menos gravosa, buscando así que la objeción no entra en conflicto con los derechos de otros individuos, especialmente con respecto al derecho a la vida.A objeção de consciência tutela o princípio do respeito à autonomia plena e consciente e a liberdade, o qual está disposto entre os direitos fundamentais previstos na Constituição Federal Brasileira de 1988, entretanto, é comum a matéria ser absorta pela sociedade jurídica e civil, em virtude de certo desconhecimento por parte dos operadores do direito e a dificuldade de efetivação por parte do Estado. A objeção de consciência de forma concisa poderia ser resumida como uma não adesão consciente a determinada norma ou ato em razão da consciência do indivíduo. Entretanto, questiona-se: Seria aceitável alguém, fundado em seus próprios princípios causar mal a outra pessoa? Pode alguém ser obrigado a agir de determinada forma, mesmo que em desfavor aos seus valores em detrimento ao bem-estar de terceiro? Desta forma, o objetivo principal deste estudo resume-se em assinalar o acesso ao direito de objeção de consciência no Brasil, bem como demonstrar à luz da bioética e do direito, o sentido conferido pelo ordenamento jurídico ao instituto, procurando chegar a uma conclusão acerca do posicionamento mais correto a ser tomado pelo Estado diante de um possível conflito de princípios e direitos fundamentais. Conclui-se que a objeção não pode fundamentar-se em caprichos pessoais, a fim de que as razões sejam proporcionais aos valores discutidos, e que o objetor esteja disposto a um possível diálogo buscando uma solução eficiente ou menos gravosa, procurando assim, garantir que a objeção não esteja em confronto com direitos de outros indivíduos, principalmente ao que diz respeito ao direito à vida.
