Analysis of Geographical Indication records deposited with the National Institute of Industrial Property - INPI

Resumo: This article aims to analyze the Geographical Indication records filed at the National Institute of Industrial Property – INPI. There are two types of Geographical Indications: Indication of Origin (IP) and Denomination of Origin (DO) and in Brazil, the INPI is responsible for analyzing, monitoring the processes and granting registration. In order to obtain data about the Brazilian scenario of GIs, a qualitative approach was used, using the literature review as a technical procedure. After the literature review, the analysis of Geographical Indication (GI) data from the base of registrations granted in the national territory until the month of July 2021 by the INPI was carried out, observing different information such as the number of GI concessions in a timeline, the its distribution by states, more specifically the GIs referring to agribusiness, DO and/or IP were analyzed and, finally, among these, the Geographical Indications of coffee growing. As a result, the research shows that the first GI was granted in 2002 in the IP modality where “Vale dos Vinhedos” became recognized as a geographical name and currently the country already totals 86 Geographical Indications, 19 in the Denomination of Origin modality and 67 in Indication of Origin mode. Brazil has 12 Geographical Indications of Coffee, including 4 DOs and 8 IPs. Only one of these records is in Bahia where there are potential regions for future GIs such as Chapada Diamantina and Planalto da Conquista.

Existen dos tipos de Indicaciones Geográficas: Indicación de Origen (IP) y Denominación de Origen (DO) y en Brasil, el INPI es responsable de analizar, monitorear los procesos y otorgar el registro. Para obtener datos sobre el escenario brasileño de IGs, se utilizó un enfoque cualitativo, utilizando la revisión de la literatura como procedimiento técnico. Luego de la revisión de la literatura, se llevó a cabo el análisis de los datos de Indicación Geográfica (IG) de la base de registros otorgados en el territorio nacional hasta el mes de julio de 2021 por el INPI, observando diferente información como el número de concesiones de IG en un cronograma. , se analizó su distribución por estados, más específicamente las IG referidas a agronegocios, DO y / o PI y, finalmente, entre estas, las Indicaciones Geográficas del cultivo de café. Como resultado, la investigación muestra que la primera IG fue otorgada en 2002 en la modalidad de PI donde se reconoció como nombre geográfico “Vale dos Vinhedos” y actualmente el país ya suma 86 Indicaciones Geográficas, 19 en la modalidad Denominación de Origen y 67 en el modo Indicación de origen. Brasil tiene 12 Indicaciones Geográficas del Café, incluidas 4 DO y 8 PI. Solo uno de estos registros se encuentra en Bahía, donde existen regiones potenciales para futuras IG como Chapada Diamantina y Planalto da Conquista.O presente artigo tem por objetivo analisar os registros de Indicação Geográfica depositados no Instituto Nacional da Propriedade Industrial – INPI. Há duas modalidades de Indicações Geográficas: a Indicação de Procedência (IP) e a Denominação de Origem (DO) e no Brasil, o INPI é responsável pela análise, acompanhamento dos processos e concessão do registro. A fim de obter dados a cerca do cenário brasileiro das IGs, foi empregada uma abordagem qualitativa fazendo uso da revisão de literatura como procedimento técnico. Após a revisão de literatura, foi realizada a análise de dados de Indicação Geográfica (IG) da base de registros concedidos no território nacional até o mês de Julho de 2021 pelo INPI observando diferentes informações como: número de concessões de IG numa linha do tempo, a sua distribuição pelos estados, mais especificamente foram analisadas as IGs referentes ao agronegócio, DO e ou IP e, para finalizar, dentre estas, as Indicações Geográficas da cafeicultura. Como resultado a pesquisa mostra que, a primeira IG foi concedida em 2002 na modalidade IP onde “Vale dos Vinhedos” passou a ser reconhecido como nome geográfico e atualmente o país já totaliza 86 Indicações Geográficas, sendo elas, 19 na modalidade Denominação de Origem e 67 na modalidade Indicação de Procedência. O Brasil possui 12 Indicações Geográficas de Café, dentre elas 4 DOs e 8 IPs.
