Resumo: | This study aims to evaluate the application of the principle of concentration in registration and the protection of the parties in property acquisition in Brazil, compare it to different legal systems, notably Portuguese and German, in order no analyze its efficiency and the possibility of future changes. The Brazilian registration system is very similar to the Portuguese one, both with juris tantum presumption and different from the German system that has juris et de jure presumption. The principle of concentration is applied in Brazilian real state law, which aims to guarantee the integrity of property acquisition, protecting the third party in good faith. With the emergence of the legal act 13.097/2015 and the Code of Civil Procedure/2015, new norms about transmission and protection of the acquirer in good faith were instituted. Furthermore, with the sole paragraph of the article 1,247 of the Civil Code there was a relativization of the protection given to the proprietor, that guarantees the transmission a non domino. Thereby, the survival of the article 1,247, sole paragraph, of the Civil Code in view of the wording of art. 54, sole paragraph of the legal act 13.097 / 2015 is at risk. It is up to the jurisprudence of STJ to interpret the law and limit the tension between the owner and the third party in good faith. For the development of the work, it was carried out an extensive doctrinal and jurisprudential research. In conclusion, legislative changes were suggested inspired by the German system with application of the principle of abstraction. |

In conclusion, legislative changes were suggested inspired by the German system with application of the principle of abstraction.Este estudio tuvo como objetivo evaluar la aplicación del principio de concentración en el registro y la protección de las partes en la adquisición de bienes inmuebles en Brasil, compararlo con diferentes sistemas jurídicos, en particular el portugués y el alemán, con el fin de analizar su eficacia y la posibilidad de cambios futuros. El sistema registral brasileño es muy similar al portugués, ya que ambos tienen una presunción juris tantum, a diferencia del sistema alemán, que tiene una presunción juris et de jure. En el derecho registral brasileño se aplica el principio de concentración, cuyo objetivo principal es garantizar la integridad de la transmisión de los bienes para proteger al comprador de buena fe. Con el surgimiento de la Ley 13.097/2015 y la Ley de Enjuiciamiento Civil/2015 se instituyeron nuevas reglas sobre la transmisión y protección del tercero adquirente de buena fe. Además, se produjo la relativización de la protección concedida al propietario con la aparición del párrafo único del artículo 54 de la Ley nº 13.097/2015, que garantiza la transmisión a non domino. Con ello, se pone a prueba la pervivencia del art. 1.247, párrafo único del Código Civil frente a la redacción del art. 54, párrafo único de la ley 13.097/2015, correspondiendo a la jurisprudencia del TSJ interpretar el dispositivo y delimitar la tensión entre el propietario y el tercero de buena fe. Para el desarrollo de la obra, se realizó una amplia investigación doctrinaria y jurisprudencial. Al final, se sugirieron cambios legislativos inspirados en el sistema alemán con aplicación del principio de abstracción.Este estudo teve como objetivo avaliar a aplicação do princípio da concentração na matrícula e a proteção das partes na aquisição de bens imóveis no Brasil, compará-la com os diferentes sistemas jurídicos, notadamente o português e alemão, a fim de analisar sua eficiência e possibilidade de futuras alterações. O sistema registral brasileiro é bastante similar ao sistema português, ambos com presunção juris tantum, diferentes do sistema germânico que possui presunção juris et de jure. No direito registral brasileiro se aplica o princípio da concentração, cujo principal objetivo é garantir a integridade da transmissão dos bens, de forma a proteger o adquirente de boa-fé. Com o surgimento da Lei 13.097/2015 e do Código de Processo Civil/2015 foram instituídas novas normas acerca da transmissão e proteção do terceiro de boa-fé adquirente. Além disso, houve a relativização da proteção conferida ao proprietário com o surgimento do parágrafo único do artigo 54 da Lei nº 13.097/2015, que garante a transmissão a non domino. Com isso, coloca-se à prova a sobrevivência do art. 1.247, parágrafo único do Código Civil em face da redação do art. 54, parágrafo único da lei 13.097/2015, cabendo à jurisprudência do STJ interpretar o dispositivo e delimitar a tensão entre o proprietário e o terceiro de boa-fé. Para o desenvolvimento do trabalho, foi realizada ampla pesquisa doutrinária e jurisprudencial.
