Fundamental rights and jus puniendi: the process as a citizen's guarantee and limit to state punitivism

Resumo: This article highlights the fine line between state punitivism and the constitutional rights of the accused, thus demonstrating the need for a legal balance. With this objective in mind, the basis of the State's jus puniendi is extracted from the very foundations present in the Federal Constitution of Brazil, as well as the pillars of the principle of the human person, with a focus on human dignity, a fundamental value of the Democratic State of Law. Faced with this situation, respect for the dictates of due criminal procedure is presented as a constitutional guarantee of the rights of the accused in the face of the exacerbated desire to punish on the part of civil society and the organizations that make up the Brazilian justice system. Indeed, the new constitutional order began to demand that the process no longer be conducted, as a priority, as a mere vehicle for the application of criminal law, but, beyond and more than that, that it be transformed into an instrument of guarantee of the individual in the face of the culture of state punitivism in Brazil.

Con ese objetivo en mente, la base del jus puniendi del Estado se extrae de los propios fundamentos presentes en la Constitución Federal de Brasil, así como de los pilares del principio de la persona humana, con foco en la dignidad humana, valor fundamental del Estado Democrático de Derecho. Ante esta situación, el respeto a los dictados del debido proceso penal se presenta como garantía constitucional de los derechos de los imputados ante el afán exacerbado de sancionar por parte de la sociedad civil y de las organizaciones que integran el sistema de justicia brasileño. . En efecto, el nuevo orden constitucional pasó a exigir que el proceso ya no se siga, de manera prioritaria, como un mero vehículo de aplicación de la ley penal, sino, más allá y más allá, que se transforme en un instrumento de garantía de la justicia. el individuo frente a la cultura del punitivismo estatal en Brasil.O presente artigo evidencia a linha tênue existente entre o punitivismo estatal e os dirreitos constituionais do acusado, demonstrando, dessa forma, a necessidade de um equilibrio juridico. Com esse objetivo, extraia-se dos proprios fundamentos presentes na Constituição Federal do Brasil, o embasamento do jus puniendi do Estado, bem como os pilares do princípio da pessoa humana, com foco na dignidade humana, valor fundamental do Estado Democrático de Direito. Diante desta situação, o respeito aos ditames do devido processo penal apresenta-se como uma garantir constituiconal dos direitos do acusado em face da vontade exarcebada de punir por parte da sociedade civil e das organizações que compõe a justiça brasileira.
