Payments for Environmental Services (PES): a study on brazilian legislation and the structuring of agreements

Resumo: The land use and occupation in Brazil was marked by the decrease of the vegetation coverage and anthropic modifications in the different ecosystems, distributed among Brazilian biomes: Amazonia, Cerrado, Caatinga, Atlantic Forest, Pantanal and Pampas. Nowadays, the approach about the ecosystems conservation and recovery needs have strengthened in national and international levels, developing economic instruments which helps the environmental management. This work aims to discuss the Payments for Ecosystem Services (PES) in the Brazilian context, addressing the legal aspects on the Federal and State scopes in the five geographical regions: Southeast, North, Northeast, Central West and South. Furthermore, introduces the procedure for structuring the agreements that enables the understanding of how this economic instrument may help the restoration and conservation of ecosystems using the Payments for Ecosystem Services, which supports the maintenance of the Ecosystem Services that stems from anthropic activities. The adopted methodology was a bibliographic review of academic articles, manuals, theses and Brazilian legislation about the Payments for Ecosystem Services. The results and discussion showed that even without a Nacional Policy that concerns about the Payments for Ecosystem Services, several states in Brazil developed their own policies about this subject. However, the PES has not been effectively implemented in some regions of the country that have a great potential to develop agreements, as in the case of Northeast.

Actualmente, el enfoque sobre la necesidad de conservación y recuperación de los ecosistemas se ha fortalecido, a nivel nacional e internacional, con la creación de instrumentos económicos que ayudan en la gestión ambiental. Este artículo tiene como objetivo discutir el Instrumento de Pago de Servicios Ambientales (PSA) en Brasil, a través de un enfoque sobre sus Aspectos Legales, en las esferas Federal y Estatal, en el contexto de las cinco Regiones Geográficas: Norte, Noreste, Medio Oeste, Sur y Sureste. Además, presenta el proceso de estructuración de acuerdos para que sea posible entender cómo este instrumento económico puede contribuir a la conservación y restauración de los ecosistemas através de Programas de pago por Servicios Ambientales, que apoyan el mantenimiento de los servicios ecosistémicos a partir de acciones antrópicas. La metodología adoptada fue una revisión bibliográfica de artículos, manuales, tesis académicas y legislaciones brasileñas disponibles sobre el instrumento económico de Pagos por Servicios Ambientales. Los resultados y discusiones mostraron que incluso sin una Política Nacional de Pagos por Servicios Ambientales (PNPSA, por sus preocupaciones), muchos estados brasileños desarrollaron sus Políticas Estatales de Pagos por Servicios Ambientales (PEPSA). Sin embargo, el PSA todavía se aplica poco en algunas regiones brasileñas que tienen un gran potencial para el desarrollo de acuerdos, como es el caso en el nordeste.O processo de uso e ocupação do solo, no Brasil, é marcado por uma intensa redução da cobertura natural e interferências antrópicas nos diversos ecossistemas, que estão distribuídos nos Biomas brasileiros: Mata Atlântica, Caatinga, Cerrado, Amazônia, Pantanal e Pampa. Esse artigo visa discutir o instrumento de Pagamento por Serviços Ambientais (PSA) no Brasil, por meio de uma abordagem sobre os seus Aspectos Legais, no âmbito Federal e Estadual, no contexto das cinco Regiões Geográficas: Norte, Nordeste, Centro-Oeste, Sul e Sudeste. Além disso, apresenta o processo de estruturação de acordos para que seja possível compreender como esse instrumento econômico pode contribuir para a conservação e restauração de ecossistemas por meio de Programas de Pagamentos por Serviços Ambientais, que apoiam a manutenção de serviços ecossistêmicos a partir de ações antrópicas. A metodologia adotada foi de revisão bibliográfica de artigos, manuais, teses acadêmicas e das legislações brasileiras que dispõem sobre o instrumento econômico de Pagamentos por Serviços Ambientais. Os resultados e discussões demonstraram que mesmo sem uma Política Nacional de Pagamento por Serviços Ambientais (PNPSA), muitos estados brasileiros desenvolveram suas Políticas Estaduais de Pagamentos por Serviços Ambientais (PEPSA).
