Law and Literature: Clarice Lispector and the process of depersonalization of the “Mineirinho”, literature as a reflection of society

Resumo: The present work sought to demonstrate the possibility of understanding the law through literature, focusing on the process of depersonalization and censorship of the rights of those who live on the margins of society, using as a basis the short story “Mineirinho” by Clarice Lispector. A historical synthesis of the interdisciplinary relationship between law and literature, in Brazil and in the world, was elaborated, approaching its emergence and evolution, in addition to the analysis of how, through the treated work, it is possible to point out how these characteristics are manifested in the reality of Brazilian society and demonstrate how much literature can be a reflection of the most varied societies. For that, a hypothetical-deductive methodology was used based on biographies on themes inherent to the subject and a dialectical method in approaching the differences between a being endowed with rights and a depersonalized being, whose rights were repressed, and description of the interdisciplinary relationship between law and literature. and its application in society.

Se elaboró ​​una síntesis histórica de la relación interdisciplinaria entre derecho y literatura, en Brasil y en el mundo, abordando su surgimiento y evolución, además del análisis de cómo, a través de la obra tratada, es posible señalar cómo estas características se manifiestan en la realidad de la sociedad brasileña y demuestran cuánto la literatura puede ser un reflejo de las más variadas sociedades. Para ello, se utilizó una metodología hipotético-deductiva basada en biografías sobre temas inherentes al sujeto y un método dialéctico en el abordaje de las diferencias entre un ser dotado de derechos y un ser despersonalizado, cuyos derechos fueron reprimidos, y descripción de la relación interdisciplinar entre derecho y literatura y su aplicación en la sociedad.O presente trabalho buscou demonstrar a possibilidade de se compreender o direito através da literatura, com foco voltado para o processo de despessoalização e censura dos direitos daqueles que vivem à margem da sociedade, utilizando como base o conto “Mineirinho” de Clarice Lispector. Foi elaborada uma síntese histórica da relação interdisciplinar entre direito e literatura no Brasil e no Mundo, abordando seu surgimento e evolução, além da análise de como, através da obra tratada, é possível apontar como essas características se manifestam na realidade da sociedade brasileira e demonstrar o quanto a literatura pode ser um reflexo das mais variadas sociedades.
