Resumo: | The use of Botulinum Toxin by dental surgeons (CD) is a complex theme/topic that divided opinions about its legality, it has been the subject of disputes in the judicial sphere. Through the study of the legislation related to the theme and the review of the current literature, this study aimed to demonstrate the legitimacy of the CD, through normative devices and technical arguments to use botulinum toxin in dental practice in a therapeutic, aesthetic and functional way, within anatomical area of performance of this professional. The research that was carried out between the months of February and August 2021, used as a base, law obtained on the Presidency of the Republic website, Resolutions available on the Federal Council of Dentistry (CFO) website, judicial decisions obtained on the Federal Regional Court website and articles found in the database of: Latin American and Caribbean Literature in Health Sciences (LILACS), PubMed and Scientific Electronic Library Online (SciELO). After applying the inclusion and exclusion criteria, 17 publications were selected to reference the research. After careful analysis, it was verified the existence of legal protection, considering Law nº 5,081 / 1966, normatization of the theme, through CFO Resolution nº 176/16 and nº 198/19, and a favorable judicial decision, which legitimize the use of the referred toxin by the CD, in addition to publications that point out its benefits and significant applicability in dentistry, which encourages further studies on the subject, considering that the current literature is still scarce. |

Mediante el estudio de la legislación relacionada con el tema y una revisión de la literatura actual, este trabajo tuvo como objetivo demostrar la legitimidad de lo CD, mediante dispositivos normativos y argumentos técnicos para utilizar la Toxina Botulínica en la práctica odontológica de forma terapéutica, estética y funcional, dentro de la área anatómica de actividad de este profesional. La encuesta, que se realizó entre febrero y agosto de 2021, utilizó como corpus, una ley obtenida del sitio web de la Presidencia de la República, Resoluciones disponibles en el sitio web del Consejo Federal de Odontología (CFO), decisiones judiciales obtenidas del sitio web del Tribunal Federal Regional de la 1ª Región y artículos encontrados en la base de datos de Literatura Latinoamericana y Caribeña en Ciencias de la Salud (LILACS), PubMed y Scientific Electronic Library Online (SciELO). Aplicados los criterios de inclusión y exclusión, fueron seleccionadas 17 publicaciones para referenciar el estudio. Después de una cuidadosa análisis, se verificó la existencia de sustento legal, considerando la Ley N ° 5.081 / 1966, que reglamenta la materia, mediante las Resoluciones CFO N ° 176/16 y N ° 198/19, y decisión judicial favorable, que legitima el uso de mencionada toxina por lo CD, además de publicaciones que señalan sus beneficios y significativa aplicabilidad en odontología, lo que incentiva estudios adicionales sobre el tema, señalando que la literatura actual aún es escasa.A utilização da Toxina Botulínica por cirurgiões-dentistas (CD) é um assunto complexo que dividiu opiniões acerca de sua legalidade, tendo sido objeto de disputas na esfera judicial. Através do estudo da legislação correlata ao tema e de revisão da literatura atual, o presente trabalho objetivou demonstrar a legitimidade do CD, por meio de dispositivos normativos e argumentos técnicos para utilizar a toxina botulínica na prática odontológica de forma terapêutica, estética e funcional, dentro da área anatômica de atuação deste profissional. A pesquisa que foi realizada entre os meses de fevereiro e agosto de 2021, utilizou como corpus, lei obtida no sítio da Presidência da República, Resoluções disponíveis no sítio do Conselho Federal de Odontologia (CFO), decisões judiciais obtidas no sítio do Tribunal Regional Federal da 1º Região e artigos encontrados na base de dados do Literature Latino-Americana e do Caribe em Ciências da Saúde (LILACS), PubMed e Scientific Eletronic Library Online (SciELO). Aplicados os critérios de inclusão e exclusão, 17 publicações foram selecionadas para referenciar o estudo.
