Resumo: | This article aims to analyze the transference relationship in Family Courts, highlighting the role of the psychoanalyst in this scenario. Part of the legal processes that arrives at the Family Courts expects the psychologist that is guided by psychoanalysis who occupies this position to carry out a study that will also serve as a mediator of the problems arising from the divorce. Clinical listening allows to the parts that are involved in the legal process to express their anxieties; as long as transference is used as an ethical device that promotes the construction of knowledge and at the same time places responsibility on the person for their position in the separation. Managing this transfer is trying to intervene so that the subject comes below or beyond the legal process supported by the demand to the judiciary. This is a theoretical study that used the literature review methodology to guide this discussion. It is concluded that when exercising the role of judicial expert, the psychoanalyst, supported by his ethics, is guided to bring out the speeches of the people involved so that he can discern what their demand is, and produce a study within his field with the purpose of offering support for the legal decision. |

Parte de los procesos legales que llegan a los Juzgados de Familia esperan del psicólogo guiado por el psicoanálisis que ocupa este cargo lleva a cabo un estudio que también le servirá como mediador de los problemas derivados de la ruptura matrimonial. La escucha clínica permite a las partes involucradas en el proceso legal expresar sus inquietudes; siempre y cuando se utilice la transferencia como un dispositivo ético que promueve la construcción de conocimiento y al mismo tiempo responsabiliza al sujeto de su posición frente a la separación. Gestionar este traslado es tratar de intervenir para que el tema quede por debajo o más allá del juego jurídico sustentado en la demanda al poder judicial. Este es un estudio teórico que utilizó la metodología de revisión de la literatura para guiar esta discusión. Se concluye que al ejercer el rol de perito judicial, el psicoanalista, apoyado en su ética, se orienta a hacer aflorar la palabra de las personas involucradas para discernir cuál es su demanda y elaborar un estudio dentro de su campo de actuación con el fin de brindar apoyo a la decisión judicial.Este artigo tem como objetivo analisar a relação transferencial nas Varas de Famílias destacando o lugar do psicanalista neste contexto. Parte dos processos jurídicos que chegam as Varas de Família espera do psicólogo orientado pela psicanálise que ocupa esse lugar, a realização de um estudo que servirá também como mediador dos problemas decorrentes da ruptura conjugal. A escuta clínica possibilita as partes envolvidas no processo jurídico expressarem suas angústias; desde que seja utilizado a transferência enquanto um dispositivo ético e que promova a construção de um saber e ao mesmo tempo responsabiliza o sujeito por sua posição diante da separação. Manejar essa transferência é tentar intervir para que o sujeito advenha aquém ou além do jogo jurídico sustentado pela demanda ao judiciário. Trata-se de um estudo teórico que utilizou a metodologia de revisão bibliográfica para nortear a presente discussão.
