Social pacification and the role of Brazilian law education: the necessary rescue of the culture of peace

Resumo: This article discusses the culture of peace in the context of Brazilian legal education, from the perspective of the 2015 Code of Civil Procedure and Resolution No. 05/2018 of the National Council of Education. It proposes a reflection on the current Brazilian legal education and its correspondence to the culture of litigation, in addition to a discussion related to the role of the teacher for the training of legal operators who understand the need and relevance of the use of alternative means of conflict resolution. For the methodological conduct of the study, a qualitative approach methodology will be used, through the deductive method, with the aid of bibliographic and documentary research. The notes found demonstrate the need for change both in the curriculum of legal courses, so that it is taught to work with conflict and to value consensual means of resolution, as well as in the teaching methodology for the use of one that privileges dialogue, critical reflection, interdisciplinarity and the promotion of the dignity of the human person.

Propone una reflexión sobre la educación jurídica brasileña actual y su correspondencia con la cultura del litigio, además de una discusión relacionada con el papel del maestro para la formación de operadores legales que entienden la necesidad y la relevancia del uso de medios alternativos de resolución de conflictos. Para la realización metodológica del estudio, se utilizará una metodología de enfoque cualitativo, a través del método deductivo, con la ayuda de la investigación bibliográfica y documental. Las notas encontradas demuestran la necesidad de un cambio tanto en el plan de estudios de los cursos jurídicos, de modo que se enseñe a trabajar con conflictos y a valorar los medios consensuales de resolución, así como en la metodología de enseñanza para el uso de uno que privilegia el diálogo, reflexión crítica, interdisciplinariedad y promoción de la dignidad de la persona humana.O presente artigo discute a cultura da paz no contexto do ensino jurídico brasileiro, sob a perspectiva do Código de Processo Civil de 2015 e da Resolução nº 05/2018 do Conselho Nacional de Educação. Se propõe uma reflexão sobre o atual ensino jurídico brasileiro e sua correspondência à cultura do litígio, além de uma discussão relacionada ao papel do docente para a formação de operadores do direito que compreendam a necessidade e relevância da utilização dos meios alternativos de solução de conflitos. Para a condução metodológica do estudo será utilizada uma metodologia de abordagem qualitativa, através do método dedutivo, com o auxílio de pesquisa bibliográfica e documental.
