The negotiated about the legislation: the positioning of the Supreme Federal Court

Resumo: The economic, political and institutional crisis in Brazil, experienced since 2014, fostered a change in labor law. The Labor Reform, Law nº 13.467/2017, introduced, modified and revoked a series of provisions in the Consolidation of Labor Laws. Among the most relevant provisions, article 611-A deals with the prevalence of the negotiated over the legislated. The new article raised doubts not only about its constitutionality, but also about the limits of the Collective Bargaining Agreement and Convention, making it essential to investigate these issues. To obtain the desired conclusions, this work sought the position of the Federal Supreme Court on the matter, as well as the doctrinal positions. In this way, the work uses a qualitative methodology that, through a bibliographic review, induces an answer to the problem. It is concluded that the position of the Federal Supreme Court is for the constitutionality of what is negotiated over what is legislated, restricting the normative power of negotiations only when they are confronted with labor parties of absolute unavailability.

La Reforma Laboral, Ley nº 13.467/2017, introdujo, modificó y derogó una serie de disposiciones en la Consolidación de las Leyes Laborales. Entre las disposiciones más relevantes, el artículo 611-A trata de la prevalencia de lo negociado sobre lo legislado. El nuevo artículo planteó dudas no solo sobre su constitucionalidad, sino también sobre los límites de la Convención y Contrato Colectivo de Trabajo, por lo que es imprescindible investigar estos temas. Para obtener las conclusiones deseadas, este trabajo buscó la posición del Supremo Tribunal Federal sobre la materia, así como las posiciones doctrinales. De esta forma, el trabajo utiliza una metodología cualitativa que, a través de una revisión bibliográfica, induce una respuesta al problema. Se concluye que la posición del Supremo Tribunal Federal es por la constitucionalidad de lo negociado sobre lo legislado, restringiendo el poder normativo de las negociaciones sólo cuando se enfrentan a partidos laborales de absoluta indisponibilidad.A crise econômica, política e institucional no Brasil, vivida a partir de 2014, fomentou uma mudança no direito trabalhista. A Reforma Trabalhista, Lei nº 13.467/2017, introduziu, modificou e revogou uma série de dispositivos na Consolidação das Leis do Trabalho. Entre os dispositivos mais relevantes, o artigo 611-A trata da prevalência do negociado sobre o legislado. O novo artigo gerou dúvidas não só acerca da sua constitucionalidade, mas também sobre os limites do Acordo e da Convenção Coletiva de Trabalho, tornando fundamental investigar essas questões. Para obter as conclusões desejadas, este trabalho buscou a posição do Supremo Tribunal Federal acerca da matéria, bem como os posicionamentos doutrinários. Desse modo, o trabalho utiliza de uma metodologia qualitativa que, por meio de uma revisão bibliográfica, induz uma resposta para o problema.
