Vegetation suppression offset in the Environmental Licensing of Small Hydroelectric Power Plants in Minas Gerais – Brazil

Resumo: The exploitation of environmental resources by humanity has always existed, with the vegetation suppression being one of the most recurrent. Social mobilization for the environmental issue gave rise to the environmental offset mechanism, which aims to balance the negative impacts of a project that could not be avoided or mitigated. The offset proposal must comply with three principles: proportionality (relationship between damage caused and compensation), spatial connection (it must be close to or in the same watershed as the impacted area) and functional connection (it must promote the replacement of lost ecological functions). This work evaluates how the environmental offset of vegetation suppression is presented in the Environmental Impact Statements of Small Hydroelectric Power Plants in Minas Gerais State, Brazil. All six cases identified between 2018 and 2021 in the licensing system were analyzed. Data were analyzed using documentary research and content analysis of the studies, applying three criteria based on the principles of offset, evaluated as "met", “partially met” and “not met”. The results indicate that only two studies fully met the adopted criteria, and the functional connection and proportionality presented, respectively, the best and worst results. This panorama reveals the lack of detail in the information presented in the studies and the need for improvement. An alarming result is that in four of the five applicable cases, the Atlantic Forest Law was not fully complied with. It is expected that this study can contribute to the improvement of the mechanism, as well as assist in Brazilian environmental legislation.

La movilización social por el tema ambiental dio origen al mecanismo de compensación ambiental, que tiene como objetivo equilibrar los impactos negativos de un proyecto que no pudo ser evitado o mitigado. La propuesta de compensación debe cumplir con tres principios: proporcionalidad (relación entre el daño causado y la compensación), conexión espacial (debe estar cerca o en la misma cuenca que el área impactada) y conexión funcional (debe promover la reposición de funciones ecológicas pérdidas). Este trabajo evalúa cómo se presenta la compensación ambiental de la supresión de vegetación en los Estudios de Impacto Ambiental de Pequeñas Centrales Hidroeléctricas en Minas Gerais. Los seis casos identificados en el sistema de licencias entre 2018 y 2021 fueron analizados. Los datos se analizaron mediante investigación documental y análisis de contenido de los estudios, aplicando tres criterios basados ​​en los principios de compensación, evaluados como "cumplidos", "cumplidos parcialmente" y “no cumplido”. Los resultados indican que sólo dos estudios cumplieron plenamente con los criterios, y la conexión funcional y la proporcionalidad presentaron, respectivamente, los mejores y peores resultados. Este panorama revela la falta de detalle en la información presentada y la necesidad de mejora. Un resultado alarmante es que en cuatro de los cinco casos aplicables, la Ley de la Mata Atlántica no se cumplió. A proposta de compensação ambiental deve obedecer a três princípios: proporcionalidade (relação entre dano causado e compensação), conexão espacial (deve estar próxima ou na mesma bacia hidrográfica da área impactada) e conexão funcional (deve promover a reposição/substituição das funções ecológicas perdidas). Este trabalho avalia como a compensação ambiental de supressão de vegetação é apresentada nos Estudos de Impacto Ambiental de Pequenas Centrais Hidrelétricas em Minas Gerais. Foram analisados todos os seis casos identificados no sistema de licenciamento do estado, entre 2018 e 2021. Os dados foram analisados utilizando pesquisa documental e análise de conteúdo dos estudos, sendo aplicado três critérios baseados nos princípios da compensação, avaliados como “atendido”, “parcialmente atendido” e “não atendido”. Os resultados indicam que apenas dois estudos atenderam integralmente os critérios adotados, sendo que a conexão funcional e a proporcionalidade apresentaram, respectivamente, os melhores e piores resultados. Tal panorama revela a falta de detalhamento das informações apresentadas nos estudos e a necessidade de aprimoramento. Um resultado alarmante é que em quatro dos cinco casos aplicáveis, a Lei da Mata Atlântica não foi cumprida em sua totalidade.
