Recognition of post-mortem socio-affective paternity and its patrimonial effects on hereditary succession

Resumo: This study addresses as its theme a new form of paternity, that is, paternity arising from coexistence and affection, devoid of genetic and consanguineous ties: Socio-Affective Paternity. The objective is to analyze the patrimonial effects of recognizing post-mortem socio-affective paternity and its effects on hereditary succession. Methodologically, this is a bibliographical research of an exploratory-descriptive nature, whose approach methods are deductive and qualitative. Data collection consists of secondary sources, including legislation, doctrine and jurisprudence, preferably extracted from digital media, such as official websites, electronic article repositories and legal document consultation systems. Data analysis and processing occurred using the content analysis technique. The results demonstrate that the recognition of socio-affective paternity is possible even after death, as long as the requirements of affection and state of possession of the child are met, duly proven in a judicial process aimed at the heirs. This recognition makes it possible to include the name of the deceased in the civil registry and, consequently, generate inheritance effects, with the socio-affective child having the right to part of the inheritance that belongs to him. According to jurisprudence, the recognition of socio-affective paternity is a trend, based on constitutional precepts and provisions of the 2002 Civil Code, as there is no specific legislation. In conclusion, when socio-affective paternity is recognized, the rights of both children will be equalized: those of the heart and blood relatives.

El objetivo es analizar los efectos patrimoniales del reconocimiento de la paternidad socioafectiva post mortem y sus efectos sobre la sucesión hereditaria. Metodológicamente, se trata de una investigación bibliográfica de carácter exploratorio-descriptivo, cuyos métodos de abordaje son deductivos y cualitativos. La recolección de datos consiste en fuentes secundarias, incluyendo legislación, doctrina y jurisprudencia, preferentemente extraídas de medios digitales, como sitios web oficiales, repositorios electrónicos de artículos y sistemas de consulta de documentos legales. El análisis y procesamiento de los datos se produjo mediante la técnica de análisis de contenido. Los resultados demuestran que el reconocimiento de la paternidad socioafectiva es posible incluso después de la muerte, siempre y cuando se cumplan los requisitos de afección y estado de posesión del hijo, debidamente comprobados en un proceso judicial dirigido a los herederos. Este reconocimiento posibilita incluir el nombre del causante en el registro civil y, en consecuencia, generar efectos sucesorios, teniendo el hijo socioafectivo derecho a parte de la herencia que le corresponde. Según la jurisprudencia, el reconocimiento de la paternidad socioafectiva es una tendencia, basada en preceptos constitucionales y disposiciones del Código Civil de 2002, al no existir una legislación específica. En conclusión, cuando se reconozca la paternidad socioafectiva se igualarán los derechos de ambos hijos: los de los parientes cardíacos y consanguíneos.Este estudo aborda como temática uma nova forma de exercício de paternidade, ou seja, a paternidade advinda da convivência e do afeto, despida de laços genéticos e consanguíneos: a Paternidade Socioafetiva. O objetivo consiste em analisar os efeitos patrimoniais do reconhecimento da paternidade socioafetiva post mortem e seus reflexos na sucessão hereditária. Metodologicamente, trata-se de uma pesquisa bibliográfica de caráter exploratório-descritivo, cujos métodos de abordagem são o dedutivo e qualitativo. A coleta de dados é composta por fontes secundárias, incluindo a legislação, a doutrina e a jurisprudência, preferencialmente, extraídas de mídias digitais, como sites oficiais, repositórios de artigos eletrônicos e sistemas de consulta de documentos jurídicos. A análise e o tratamento de dados ocorreram por meio da técnica de análise de conteúdo. Os resultados demonstram que o reconhecimento da paternidade socioafetiva é possível mesmo após a morte, desde que se atendam aos requisitos de afetividade e estado de posse de filho, devidamente comprovados em processo judicial destinado aos herdeiros. Esse reconhecimento possibilita a inclusão em registro civil do nome do falecido e, consequentemente, geram efeitos patrimoniais sucessórios, tendo o filho socioafetivo direito a parte da herança lhe couber. Conforme jurisprudência é tendência o reconhecimento da paternidade socioafetiva, baseando-se em preceitos constitucionais e dispositivos do Código Civil de 2002, pois não há legislação específica.
