Analysis of judicial demands in health at the Regional Health Department XII

Resumo: The management of lawsuits in health represents a challenge for most Brazilian municipalities. Many papers described in the literature characterized properly the problem as well as discussed the repercussions on the Unified Health System.In this context, the objective of this study was to analyze the situation of health judicial processes at the twelfth Regional Department in Registro, São Paulo´s state, evaluating the profile of the users who claim in court the couverage of treatment´s costs as well as examination, procedure or medication. For this, we analyzed data on lawsuits in the health field at the twelfth Regional Department in Registro (SP) from january 2009 to october 2015.The variables studied were gender, age, municipality of origin of the lawsuit, the mentioned disease, the medical prescription origin, specialty of the prescriber, type of lawsuit triggered, year of the lawsuit, entity judicially triggered and requested items. It was analyzed thirty-eight lawsuits against the twelfth Regional Department, it was observed the prevalence of the female gender, age group above 51 years and originating from the municipality of Registro (SP).The most of the judicial actions are for care given at the Unified Health System, by prescribers of specialty in Clinical Medicine and diagnosed with Diabetes Mellitus. The processes were characterized in the majority by judicial actions called Ordinary Rite, against the State. On the analyzed cases, 92% requested only medications and of these 11% supplements like vitamins and enteral diets.The number of patients who have been served through legal actions in the last three years reached 47% of the total cases registered during the period of the seven years analyzed and the approximate cost was R$ 1,340,000.00.This study contributes to the diagnosis of the processes related to the health judicialization in the region studied. The results showed a predominance of processes which comes from of patients with Diabetes Mellitus which reinforces the emergency needs to discuss public policies able to attend the needs and demands of the community based in the changes generated by the increase of chronic diseases.

En este contexto, el objetivo de este trabajo fue analizar la situación de los procesos judiciales de salud en la región del Departamento Regional XII - Registro, Estado de São Paulo, evaluando el perfil de los solicitantes que pleitean en juicio el costeo del tratamiento, examen, procedimiento o medicamento. Para ello, se analizaron datos sobre las demandas judiciales en la salud del Departamento Regional de Salud XII (DRS XII), Registro / SP en el período de enero de 2009 a octubre de 2015. Las variables investigadas fueron género, edad, municipio de origen de la acción, de acuerdo con lo establecido en la Ley Orgánica del Trabajo, en la que se analizan los resultados de la evaluación de los resultados de la investigación. de 51 años y originarios del municipio de Registro. La mayoría de las acciones son de atención realizada en el Sistema Único de Salud, por prescriptores de especialidad en Clínica Médica y con diagnóstico de Diabetes Mellitus. Los procesos fueron caracterizados en su mayoría por acciones del tipo Rito Ordinario, contra el Estado. De los procesos analizados, el 92% pedía solamente medicamentos y de esos 11% solicitaron simultáneamente suplementos como vitaminas y dietas enterales. El volumen de pacientes que pasaron a ser atendidos por medio de acciones judiciales en los tres últimos años alcanzó el 47% del volumen total registrado en el período de siete años analizado, y el gasto aproximado entre 2009 y octubre de 2015 fue R $ 1.340.000,00. El estudio inédito en la Región de Registro contribuye al diagnóstico de la judicialización de la salud en el área de cobertura del DRS XII. Los resultados presentados demostraron predominio de procesos de portadores de Diabetes Mellitus lo que refuerza la necesidad de discusión de políticas públicas que atiendan la necesidad de la comunidad, con base en los cambios generados por el aumento de las enfermedades crónicas.A gestão de demandas judiciais na saúde representa desafio para a maioria dos municípios brasileiros. Muitos trabalhos descritos na literatura caracterizaram adequadamente o problema e discutiram as repercussões sobre o Sistema Único de Saúde. Neste contexto, o objetivo deste trabalho foi analisar a situação dos processos judiciais da saúde na região do Departamento Regional XII – Registro, Estado de São Paulo, avaliando o perfil dos requerentes que pleiteiam em juízo o custeio do tratamento, exame, procedimento ou medicamento. Para isto, foram analisados dados sobre as demandas judiciais na saúde do Departamento Regional de Saúde XII (DRS XII), Registro/SPno período de janeiro de 2009 a outubro de 2015. As variáveis pesquisadas foram gênero, idade, município de origem da ação, doença referida, origem da prescrição, especialidade do prescritor, tipo de ação, ente acionado, ano de entrada da ação e itens solicitados.Foram analisados 38 processos judiciais contra a DRS XII Registro, identificou-se a prevalência do gênero feminino, faixa etária acima de 51 anos e originários do município de Registro. A maioria das ações é de atendimento realizado no Sistema Único de Saúde, por prescritores de especialidade em Clínica Médica e com diagnóstico de Diabetes Mellitus. Os processos foram caracterizados em sua maioria por ações do tipo Rito Ordinário, contra o Estado. Dos processos analisados, 92% solicitavam somente medicamentos e desses 11% solicitaram simultaneamente suplementos como vitaminas e dietas enterais. O volume de pacientes que passaram a ser atendidos por meio de ações judiciais nos três últimos anos atingiu 47% do volume total registrado no período de sete anos analisado, e o gasto aproximado entre 2009 e outubro de 2015 foi R$1.340.000,00.
