Judicial deliberation as a condition for the standardization of jurisprudence in the Higher Courts: sustainable jurisdiction

Resumo: | The current Brazilian legal system is organized in such a way that jurists, especially in the Superior Courts, use their position of authority not to use the deliberative method in their decisions. Thus, there is the construction of precedents and enunciations that are limited to the opinion of the Justices, expressed in general formulas that will form the body of judicial precedents, conditioning the admission of special and extraordinary appeals, in the light of the provision of article 1.030, caput, of the CPC/15. The Courts weaken collective deliberation, to the extent that it authorizes the individual conduct of the ministers. Thus, in order to analyze the deliberative performance of the Courts, a bibliographic and jurisprudential survey was conducted, through which it was possible to understand that the deliberative method directly impacts the legal security of the Judiciary, since it is closely linked to the legitimacy of the decision-making power that is progressively conquered. However, the Higher Courts have not been deliberating, condemning the decision-making process to ruin and bringing about a problem of legitimacy of the institutions as judging collegiate. |

Así, existe la construcción de precedentes y declaraciones que se limitan a la opinión de los ministros, expresada en fórmulas generales que formarán el cuerpo de precedentes judiciales, condicionando la admisión de recursos especiales y extraordinarios, a la luz de la disposición del artículo 1.030, caput, del CPC/15. Los tribunales debilitan la deliberación colectiva, en la medida en que autoriza la conducta individual de los jueces. Así, para analizar la actuación deliberativa de los Tribunales, se realizó una investigación bibliográfica y jurisprudencial, a través de la cual se pudo comprender que el método deliberativo impacta directamente en la seguridad jurídica del Poder Judicial, ya que está estrechamente vinculado a la legitimidad del poder decisorio que se va conquistando. Sin embargo, los Tribunales Superiores no han deliberado, condenando a la ruina el proceso de toma de decisiones, lo que conlleva un problema de legitimidad de las instituciones al juzgar de forma colegiada.A atual ordem jurídica brasileira é organizada de forma que os juristas, em especial nos Tribunais Superiores, utilizem de sua posição de autoridade para a não utilização do método deliberativo nas decisões. Há, assim, a construção de súmulas e enunciados que se limitam à opinião dos ministros, expressas em fórmulas gerais que formarão o corpo de precedentes judiciais, condicionantes à admissão dos recursos especial e extraordinário, à luz da previsão do artigo 1.030, caput, do CPC/15. Os Tribunais enfraquecem a deliberação coletiva, na medida em que autoriza a conduta individual dos ministros. Dessa forma, com o objetivo de analisar o desempenho deliberativo dos Tribunais, foi realizada a pesquisa bibliográfica e jurisprudencial, pela qual foi possível compreender que o método deliberativo impacta diretamente na segurança jurídica do Poder Judiciário, uma vez que está intimamente ligado à legitimidade do poder decisório que é conquistado progressivamente.
